Would it be possible for you to pay for private or boarding school and pay the school directly with the school not being able to refund the family the fees if they pulled the kids out. That way you are helping the kids get a better education but not give the family the money directly?

As long as the parents are still their legal guardian (and alive) they wouldn’t be able to be adopted- parents would have to give up their parental rights. I know this does happen in places like haiti where parents feel the child would be better off in someone else’s hands. (Doesn’t appear thus is necessarily the case though)

 

like sime one said if you feel the kids are being neglected social services can be contacted.

 

https://jis.gov.jm/information/faqs/adopting-a-child-in-jamaica/ You  would have to follow the process for adoption in Jamaica AND THEN how to get the kids immigrant visas to the US once adopted-this can be found on us gov website. Many requirements, long and expensive process but not necessarily impossible as most posters are suggesting.

The problem isn't the adoption necessarily, but that the adoption won't qualify for any immigration benefits. Those are 2 separate issues.

It does-  IH3 visa for countries that have implemented The Hague convention https://www.uscis.gov/adoption/bringing-your-internationally-adopted-child-united-states

Again, not easy, fast or cheap but it can happen.

True if it's a Hague convention country, but they don't just grant those types of adoptions to relatives. They are generally strangers or where the parents are no longer alive. The I-800 requires meeting one of the following criteria:

 

A guardian who is:

"* An individual or entity other than the child’s birth parents. (This includes any child welfare agency, orphanage, or other individual or entity that has custody of the child, a legal guardian, or any person(s) who is (are) the child’s parent(s) based on a prior adoption.)

* The child’s living birth parents, each of whom has consented to the adoption and who are incapable of providing proper care to the child.

* The child’s surviving birth parent, because the other birth parent is dead, and the child has not acquired another parent (as defined in 8 CFR Part 204.301).

* The child’s sole birth parent, because the competent authority has determined that the child's other birth parent has abandoned or deserted the child, or has disappeared from the child’s life, and the child has not acquired another parent (as defined in 8 CFR Part 204.301)."

 

Note that point #2 is very, very difficult to prove (i.e. documented physical abuse, unable to provide basic food & shelter, etc.) and would be the only viable option.

Jamaica did sign The Hague convention. And yes, the #2- the parents would have to give up their kids due to hardship would be the way to go IF the parents gave up their rights. Not impossible but definitely not easy.

If you're so interested in making their lives better -- send them some money on a monthly basis, it may help. Forget about bringing them to the US -- it's not a fast nor easy process, it will take long YEARS. You can't adopt and bring them to the US only because "you want" or "you think it will be better" or "they have bad conditions". A few billion people on this planet are having even worse conditions, so does it mean we should bring all them here? Nope. Work on this, go there, support them, invest lots of money and time, and one day they may get their visas.

But geowrian also pointed out that they don't grant those types of adoptions to relatives. OP's husband is related by blood since the children are his sibling's.

I think OP stated she wanted the money to be used properly because if sent to the parents it will definitely be misused..OP is there anyone trustworthy you and hubby can trust and depend on in JA? You seem to have a very big heart and wanting to help out so much and I admire you for that...I am hoping you guys can find another solution to this issue...Best of luck to you!

You cannot adopt children when their parents are alive for the purpose of immigration to the United Sates. Period. End of story. If you don't believe those of us on this forum who know, then pay they money for an attorney to tell you the same thing. Your call.
