Hi guys,

 

I've met my fiancee online and so far we've been dating for 1 year and 4 months. During this period she was waiting for the divorce and now that divorce came out we will meet in person for the first time next week so we can apply for the k1 visa.

 

My concern is Will they deny our case because we dated online whilst she was still legally married?

An online relationship while separated is not normally a problem in itself.  However, depending on the country of origin, meeting multiple times and a lot of time together helps to overcome doubt about a bona fide relationship.  From a practical standpoint, more time together before marriage is always a good thing.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

When my US fiancee and I began our relationship, she was still legally married to her ex-husband but physically separated, obviously. They were legally divorced a few months before we filed. We had no issues at all with the petition nor at the interview.

Definitely would depend a lot on the embassy.   I was separated a year and half when I met my now husband.   We did not plan a trip in person until the divorce was final.   It never came up in the interview.   I did submit all court documents ahead of time I'm not sure if it made any difference.   

 

Although only meeting once is a requirement to file I would recommend having another meeting at least before the interview.

This! I'd suggest even wait until you meet 2 or 3 or 4 times before you file anything. It doesn't only increase your chances of approval but it gives you time to truly meet someone and be sure that you actually want to spend the rest of your life with them.

If you haven't met yet, I'd suggest waiting. Requirements include having met at least once within the last 2 years prior to filing, which would technically suffice in that case if you file after meeting the first time. However, the more physical time together the better. Filing on your first visit together can sometimes be a red flag when reviewing your application. Prior divorce in itself should not be a problem. As long as you are both legally free to marry at the time of application is what matters.

K1- You have to meet once within last 2 yrs 

 

you said you are meeting her her next week but maybe you should have multiple meetings before you move w the process? This is someone you are planning to spend the rest of your life with.

 

Dating while she she was still married and k1 process being initiated so soon after a divorce will throw red flags for sure but isn’t an “automatic denial”.

i would meet more than once before filing for a K1, myself.

 

Paul and I were both still legally married (but separated) when we started talking/ dating. We filed after his divorce was final. But we also had been together for over 2 years at that point and had many many MANY visits between us. 

 

as long as you dont file or try to marry until legally able to do so, USCIS doesnt care.

 

But again, id meet far more than once before agreeing to marry ANYONE. i dont care how long id known them online.  However, the minimum requirement is meeting once within 2 years of filing (not actually being together 2 years, as someone tried to tell you).

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Hi , i met my fiance after legally separating for my ex husband , we met through ig and we talked for a while then met in person while i was still married lol but it dont matter cuz i was legally separated . Ive seen my fiance 3 times already i just applied for k1 in march so far ive herd everything is goin fine with my case havent got a rfe or anything basically . If you wanna apply after you meet her is fine but i recommend you visit once more before interview and get new pictures and stuff like that . Just so they know you guys have kept relationship going . Goodluck

I don't think I've ever heard of anyone getting an RFE for dating while separated (or even still married, as I'm sure has happened). RFE for no divorce decree (or unacceptable one)? yes. But for what happened BEFORE the K1 in regards to former marriages/relationships and who was with who at what time? not that I can think of. As long as you are free and able to legally marry when you FILE, it's all good.

That’s not true. All you need is one in-person meeting to file for K1. You need divorce certificates before filing but that’s about it.

 

However, if you haven’t even met in person should you really be getting married? I mean you met online. How well do you really know someone you met online?
