Hello, I am searching for an answer. 

I would like to know if anyone has ever filed their N-400, and received back from USCIS a rejection letter as to the Filed N-400. Basically, I would like to know if  they (USCIS) Gives you an EXPLANATION of why your application (N-400) was denied, etc. 

Alternatively, if anyone has made an appointment with the local USCIS office to ask if and when you are eligible to apply for naturalization via the N-400? And if they were able to give you that information or not. 

Thank you for any assistance you can provide!

Here is the link to Naturalization information.  We came on a K1 Visa, so my husband was eligible for naturalization based on a 3 year rule (not 5).  The application was accepted, so I don't have information on what is received with a rejection.

3.7.2017     NOA sent

3.23.2017   Biometrics Appointment

2.26.2018   I-751 Transferred to Local Office

3.5.2018     I-751 Received in Local Office

Question #1: Don't know what all would be included in a (potential) letter of denial.

 

Question #2:  They would be able to give you that information; however, in most cases, you don't need to make an appointment to obtain this information. How and when did you obtain your Green Card (if you have one)? These answers and more information will help others on VJ to help you with the answer of if/when you would be eligible to apply for naturalization.

Hi, yes, I certainly understand your thinking. But, I have a very unique and complicated case with uncertainty about how they have me as in their system. (LPR since 2012 K-1. Married to a US citizen but also a returning resident) That's why I wanted to know if USCIS will be able to answer my question of if I am already eligible to apply or at the very least tell me when I will be able to apply.  I think I will just make an appointment with them to get clarification. Thank you for your reply!

You're welcome. And, by all means, make the appointment if you feel it necessary; they'll give you an answer. However, there are some seriously experienced folks here on VJ that have heard and advised on much, and can probably give you the information you seek; but, more information would be needed about your circumstances. For example, you say returning resident...is that you? If so, how long have you been out of the U.S.? Did you obtain a re-entry permit, if the time away was significant? How many times since obtaining your GC were you away? Are you still married to the USC that sponsored your original GC?

 

Your situation may not be as unique as you think. But, whether you choose to share the full scenario here and receive feedback, or make the appointment to learn of your options,  good luck to you.

I'm not sure I can explain it 100% correctly, so that is why I will choose to make an appointment. As long as I know that they will be able to give me an answer as to when I will be able to apply, or if I am already able to apply. The question of if they will be able to give me that answer is what I was looking for. Thank you so very much for your time and help :)

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).
