I and my fiance are waiting for NOA2 and Im so nervous of the interview.

We met only once and it was even 3 years ago. But we truly love each other and we have a lawyer too.

So Im just worried if the number meeting would affect negatively in the interview.

Also Im pretty young to get married so Im worried it would affect too.

When did you first meet and when did you send your petition? Are you us citizen? What country is the foreign fiance from?

You do realize that the main requirement of the k1 is that you have met in person in the past TWO years right? 

 

Did you investigate the process and see that requirement? 

 

Also if you are both young....why would you WANT to marry someone you haven't seen for so long? People change a lot during their teens/twenties...

 

Your lawyer should have known this very basic requirement of the K1. If they advised you it would be fine then obviously they have no idea what they are doing. 

 

You petition WILL be rejected and you will have to start over again after you meet in person again.

OP, meet with your "fiance " in person and prepare to refile your k1 petition

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Please read through the instructions very carefully that accompany the form. If you've missed this crucial requirement, who knows what else you might have missed? $535 is a lot of money to lose. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

There are very few requirements for k1 and one is having met within the last two years. Don’t expect an approval if you couldn’t follow the requirements.

read thru all the fees as after marriage AOS is expensive $1225 which includes $85 for biometrics

also u r young, do u know if u meet the 100% poverty level income and the 125% needed at AOS stage?

travel to meet again and fees for applying for visa and then paying for visa if u get it and u can't get it if not met in last 2 years as said above

 

If this is suppose to be an immigration lawyer,  he/she needs to be reported

I read the title of your post from the home page and I've got one thing to say:

 

YOU MUST BE KIDDING !

 

...But if this is actually happening, i'm not an expert or anything but even a 5 year old will tell you will get denied.

Why would you wait untill AFTER you applied for the K1? If you asked us this before we would of been able to advise you, now its too late and you could be denied, they state you have to of met within the last 2 years... if you get approved then you would be very lucky.. Just prepare yourself for the worst, i wish you good luck

yeah... so .... one of the BASIC requirements to submit a successful petition (and who would want to submit one that is NOT successful?) is that you HAVE TO HAVE MET WITHIN 2 YEARS OF FILING THE PETITION.

 

Sure. you can apply without having done so. You're right. there is no rule or law that states you CAN'T. But it will not be approved because it does not meet the basic requirements. And you just wasted a whole lot of time, $535 plus incidental costs,  and took up valuable time of the USCIS officer, who could have been working on a petition for an applicant who understands what they are doing (or at least can follow basic instructions) and is more likely to get approved.

That was stupid. Did you not read the application process at all? That is like the main demand of the K1 visa. You just spent all that money and time (you won’t hear back for 7-9 months since filing) for a glorified paper that says denied. You won’t get the money back. You won’t get the time back. Your lawyer should be disbarred because that is very BASIC knowledge of the K1 process. It cannot get any more basic than that. Start doing a lot of research and get ready to file again if you want to proceed with this. You won’t get an RFE, you won’t be allowed to appeal it, you will get a flat out denial.

Not physically seeing each other over the past 2 years from the date of filing will result in a denial.

 

No refund, no appeal, no way around that basic requirement (except for a proven medical reason/prevented from travelling).
