Guys!!!!! My RFE letter is on the mail and my fiance sent me a few pictures of it, here's what they are asking for: (sorry for the poor quality).

-Meeting requirement: I think they got the question wrong because they asks for something they said we submitted (but we didn't), so I'm guessing to send my passport showing my only entry to Mexico, residence card from Mexico and Mexican visa? I haven't left Mexico since I got here in 2016, maybe all pages of passport (blanks)? Should we add again his passport (the one with the stamps for coming here).  I don't have much on my side other than prooving I live here since that time and that I haven't left.

And we missed a box on the form.... (Answer is no)

What is this on the last paragraph about the IBM Regulation Act of 2005?

I guess our rviewer typed over another RFE template because some information doesn't make sense lol

I got nervous just by reading this...

Wow, lollll. Good luck. we are still waiting on our RFE hard copy. Haven’t got anything yet.

If that last sustenance turns out to be a concern about IMBR then I offer this example of how to answer.

Take the Cherry Blossom letter and the CB's TOS along with a letter (see example of letter below) from you and send back with a copy of the RFE. Be sure to make a copy of everything you send back. Also, send it so you can track the package to USCIS. Both of you should sign the letter. You can send it to the other for signature as a pdf attached to an email. Print and signed and the scan and return for inclusion into your reply back to USCIS.

To whom it may concern:

I met my fiancé (name) on Cherry Blossoms and to my knowledge and evidence by the enclosed letter, Cherry Blossoms is not an International Marriage Broker. There are no introductions or matchmaking services or social referrals between US Citizens and foreign nationals. There are no written consent forms or contracts that members are required to sign. Members search and communicate with others from their own free will.

My fiancée (name) or I did not pay or signed a written consent authorizing the release of personal information. There were no introductions, both of us communicated with our own free will. I have enclosed a copy of the letter from Cherry Blossoms stating that they are not a IMB company and they do now run their website as such.

I hope this gives you a better insight on the workings and our experience with Cherry Blossoms.

With best personal regards,

XXX and XXX

attachments: Cherry Blossoms Terms of Service (TOS); A letter from Cherry Blossoms; a copy of your RFE; this letter

Thanks for this, we are attaching a cover letter in response to the RFE and here's what we are planning to include about that topic:

(I wrote the letter so is still pending for the grammar review from my fiance :D)

And we do plan to include the Terms and conditions and an statement letter from them... Do you think this might cover it? Or should I follow your original suggestion?

The thing about IMBRA is not misplaced.  The regulation requires International Marriage Brokers to investigate criminal histories and disclose that information to the other party when making a match.  The IMBRA also requires the beneficiary be informed of any criminal history that the petitioner has.  It's just confusing cause the name of the regulation so specifically mentions IMB but it also covers criminal history related issues.  That is why it states that the criminal history will be disclosed to the beneficiary pursuant to IMBRA.

Oh I see, but I still don't get it... so they still want us to include information about the dating site not being an IMB? and the answer about the missing box (criminal records), we are including on the cover letter that he has no criminal background to disclose and also completing the new box they sent on the letter)...

It looks misplaced because the paragraph itself doesn't make sense, they don't say they are asking anything additional on the topic, but if the answer YES on the criminal records then they will disclose that to me according to the regulation of the IMBRA but why they even mention the regulation?

Do you know what will be the proper action here?

Nevermind I got it, I just read about IMBRA and it's different from IBM... Do you still think we should add the information about the dating site? they don't ask for it but just in case...

I'll post here the information about IMBRA in case someone else need it:

The International Marriage Broker Regulation Act of 2005, also known as IMBRA, is a law that was enacted to reduce abuse of marriage-based visa recipients. It adds a few safeguards to the screening process that are intended to protect both the visa applicant and U.S. petitioner.

Key Provisions of IMBRA

1. Mandating Background Checks

IMBRA mandates that all U.S. petitioners get a background check and that the criminal record is disclosed to the visa applicant, regardless of the petitioner’s wishes.

2. Providing Marriage Broker Disclosure

IMBRA requires the petitioner to disclose to USCIS that he or she met his or her fiance through an IMB. If the IMB you use doesn’t meet IMBRA standards, you may be denied.

3. Stopping Serial Petitioners

IMBRA limits the number of K1 visas an individual U.S. petitioner can apply for in their lifetime to two. This lifetime limit doesn’t apply to spousal visas.

4. Disqualifying Abusive Petitioners

IMBRA mandates that if a petitioner has a record of certain violent or sexual crimes, they are immediately disqualified from petitioning.

Exceptions to these statutes require a waiver. Waivers are almost never granted.

We have been waiting for 236 days already. They just told us that the security check is pending and there’s no timeframe for that. I’m losing my mind. Don’t know what to do anymore. Do you guys have something in mind? Should we start contacting the senator? What do you guys think?
