Yes it can be.. Just because they said you’ll be getting an RFE doesnt mean you will really be getting one. They can still consider your case for an approval if they want to depends on someone adjudicating it.

I then received a letter saying that within 45 days I may receive an approval, an RFE, an intent to deny, or a denial.

If that’s their response, surely one of these days you will be receiving the hardcopy. Most likely they will update the website first then 3-5days you will have their mailed letter..

I'm not saying don't be hopeful, I'm just saying be aware that there isn't a lot of consistency in what the different officers are offering as correct info. I call every day and almost every day, I get a different answer. I stopped trying to guess.

Here’s my own experience. We called USCIS Aug. 13th and we were told that they mailed out our RFE Aug. 10th that was dated Aug. 8th. Aug. 18th came and still we received nothing. Then on Aug. 24th they emailed our Congressman that they haven’t sent(see how they lied to us) our RFE letter yet. Aug. 25th they emailed me that they already took action on our case and that’s the RFE. Aug. 30 we received the hardcopy dated Aug. 27th.

I saay do what do will do. Read the RFE carefully. Respond with all they ask for. Cover letter is fine. Return your package according to the instructions contained in the RFE. Include your original RFE letter. Make a copy for your records of everything. Once they receive your packet you should see action taken on your case 2-3 weeks. Good luck.

The answer lies within the RFE if one is issued. The agent is reading only what is in their notes. It's not unheard of that a case could be "pending" an RFE but something changes the mind of the adjudicator and it's postponed. The answer is not always calling and demanding an explanation. There is a process and letting the process work will bring down your anxiety. IMHO.

That obviously seems much more stressful and is my fear. Has anyone heard of someone just getting denied at this point? I have not seen that on this board. 

Here is what I have seen, same as your case. One couple had their RFE which they answered to the satisfaction of the AO and subsequently their application was approved. My guess is that the ITM letter, which was with the original package, was lost during the initial scanning process in receipt. It can and does happen with the amount of paper that travels through that facility.

 

Second couple, same situation. Sent in what was required, never made it to the adjudicating officer so the AO NOID the file. Couple is devastated. Inquired to why and got simple without merit replies. Finally they get an answered from USCIS that stated that the couple never responded to the RFE and that their case is denied. So they are on the phone back and forth with USCIS to no avail. In the end they got their congressional representative involved and after 2-3 months it was resolved and they were approved. Of course they had documentation that proved they sent a "package" and it was signed for by USCIS which is why they reopened the case.

 

No one can say with any certainty how your case will go. You will just need to stay on top of it. Good luck.
