You can apply for AP at the same time as AOS. However AP approval is taking a long time too, you can find the average processing time here on VJ.  edit: The beneficiary should definitely DO NOT leave the country without AP or AOS ***, you won't be let back in.

Looks like AP is currently just under 5 months? Yikes. My fiancé sister is getting married next summer in Ireland and his dad is in heart failure. The timing of all of this is just horrible. Should his dad pass after he comes here, I guess he will just go home and we will refile a CR1 visa (I think that’s what it is?) for married people and spend another year apart. He will have no job and no place to live during that time. It will be awesome. But given how this process has been working, I’m 100% sure that this will end up happening. 212 days...

My fiance does not want to get the senator involved, but we were considering putting in an enquiry with uscis for out of processing time. At this point I'm like whatever! this situation is ridiculous and I'm not going to stress myself over it. I don't want to do anything that will make it worse.

Always remember “Something is better than Nothing”. It’s better to do what you can do right now to get an update about your case rather than just waiting for an unknown time when they want to adjudicate your case. Submitting an online inquiry is the least thing you can do this moment to lessen some stress and anxiety.

Do you get an immediate acknowledgement email or it takes awhile to get a response?

You’ll be getting a response few minutes after you’ll do the online inquiry. And the date when to expect for their reply about your case.

I think you can get an emergency ap approval. Maybe one of the more experience posters can clarify.

Well I have seen many cases here on visa journey where a couple days after Congress sends in their inquiry a case will have a decision. No one not me nor you or anyone 😭 know exactly how the uscis works but I’ve seen plenty times where Congress helps

I agree with your statement that no ones knows exactly how the USCIS works which also can be applied to your Congress statement. No one knows if there is a intervention from congressmen if it has an effect on the speed at which a file is adjudicated. We can guess, but in the end no one knows. :)

Old website NOA1: 15/2

New website : 19/02
RFE: today

We just received an RFE in the mail today. No website updates, no email, nothing. I am not sure if that is good or bad news.

The RFE is about 6(!!!) incomplete questions, which is weird since we have a copy of the form we sent out and everything is filled out. Anyways, one of the questions we, apparently , left unfilled was " did you meet in the last 2 years? yes or no" - its in page 8 of the petition, question  53.

Do you guys thing we should reply with just circling the YES or should we also attach again the respective evidence?

When you get the hardcopy of the RFE, read over it carefully. Assemble or complete what they require to satisfy the RFE. Sign and return according to the instructions contained with in the RFE. Keep it simple. Do as they ask but don't seek revenge and send a 120 page document back to answer the question. Most get approval once the RFE is returned and will see that movement approximately 2 weeks after USCIS receives your response. Good Luck.

Hello,

I just received my RFE letter after 5 days of my text/email notification. It is requesting me to submit evidence that my divorce decree is recognized in New York since I got divorced in the Dominican Republic and neither my ex or myself resided in the Dominican Republic during the time the divorce was obtained. I really don't know what to provide USCIS with as I previously filed a k1 petition with same divorce decree and that petition was approved with no problem. Has any of you been in a similar situation as me? Do you have any suggestions? Thank you

Take your divorce decree to your local county courthouse and with the RFE work with the staff there to satisfy USCIS. I am sure if you approach this with the need for help, someone there will give you time and help rectify the situation.

You're not going to move forward until you can satisfy what USCIS is asking for in the RFE. Each application stands on it's own. Rules change over time. What worked last week may not work this week. Nothing is chiseled in stone with USCIS so neither should you. Good luck.

Hi,

Hope everyone's applications are going smoothly!

I just had a question about the process after entering on a k1 visa, i know that adjustment of status has to be filed, but my dad is getting married next spring in Europe (i know the adjustment of status takes a WHILE)- i read something about applying for advanced parole to leave the country? does anybody know anything about this or if it is possible to leave the country for a short period of time without negatively affecting the application?

With a AP card you can leave for short periods of time and 30 days is a safe time period. More than that and USCIS thinks you have abandoned your AOS and will deny your case and push it aside to gather dust.

Here is a good primer on the AP process: http://www.travelinsurancereview.net/2010/03/31/are-you-able-to-travel-out-of-the-us-while-awaiting-your-green-card/

This is what we are talking just the last time. If you answer yes, it will ask you to describe on how you met. This is the safest way to describe.

Explain how you met(through a friend, relatives, online, etc) in details and include the date. Who first contacted who, how did you develope feelings for each other those things. Then also decribe how you met in person. Who went to whose country, how did you spend time together, etc. You should always include a date in order for them to see the timeline of your relationship. Hope this helps...😊

Note: If you met online, you should include the TOS of the dating site in your RFE response.

Still waiting 😔

This is the reply we received yesterday after sending the online inquiry. Anyone has ever received any response similar to this one?

On 09/04/2018, you or your representative contacted U.S. Citizenship and Immigration Services (USCIS) about your I129F because you believe your case is outside normal processing times. Below is a summary of what we found and how the issue has been or may be resolved.

Thank you for your inquiry. We recognize your interest in the final adjudication of your pending application/petition and are aware of the difficulties caused by any delay in processing. We regret we are not able to give you a timeframe for when we will review your case but the California Service Center is committed to processing this workload. We will be making every effort to adjudicate your case in the most efficient manner based on our available resources. We appreciate your patience and understanding.
