The question on the application doesn’t say have you been convicted it says have you been arrested. It’s very clear and it was not very smart to lie on the application beqxuae you think it’s unfair.

 

uscis doesn’t care about criminal convictions or arrests unless they are adam Walsh acts - google it if you aren’t aware of them but they are generally sexual crimes and crimes against children. 

 

uSCIS does care about honesty and there is another vj memebr from June 2017 that didn’t disclose his arrest (very minor) got to the embassy Stage and after interview he was told the beneficiary was approved and they did one more check and saw the arrest and his fiancé got the visa denied because  he the petitioner lied on the application. 

 

now he has to start all over again and file a cr1. Wasted 11 months and thousands of dollars.

That lawyer gave you horrible advice. No lawyer should tell you to lie on an official immigration application

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

The question is “have you ever been arrested” and the answer for him is yes. I’m sorry it’s not the answer you wanted but we cannot advise people it’s ok to lie on this forum. I hope you get an rfe and it’s an easy fix, good luck.

That's what we did, one letter of intent and signed by both but they said, we need to send in my letter of intent separately and his detailed declaration of how we met. Those were our RFE's dated August 30th, that we got in the mail yesterday and we mailed the response today. Hoping for the best for everyone!

Yeah, I literally copied the exact letter that I see on pretty much every sample on half a dozen internet sites with K1 samples (including this one lol). I don't get it AT ALL but that's all they asked for so we just rewrote it again from only him and he signed it (he's here visiting) and sent it back. I'm just hoping I didn't misunderstand what they wanted but it seemed pretty straightforward in the RFE. But how that could be the thing that delays this whole process by a good month, I just don't get. Feb 16th NOA1...fingers crossed we are approved by September 16th...7 months!

Me! I’m growing so impatient February 14 old site new site Feb 19. I pray to God this week or next we have our approval or something so that he can make it here for the birth of our daughter or at least 2weeks after. I want to cry every day this is the first time we have been apart since we got engaged in October

That's so interesting that we both had the same thing (mine was only letter of intent) and everyone else did it the same as us and were approved. Makes me wonder if it just depends on the person reading the case? Maybe we had the same person lol. It's so odd and confusing to me. I don't get how something so simple as a four line letter could be what holds up an entire detailed application!!! But I guess we don't get to know the details...we just get to wait and see!

I know and that took them 6+ mos for us to comply with?
