To follow up on your posting in the closed thread I offer you this explanation.

 

You are referring to someone who is processing through a EBx visa. There are number of EBx types of visas. Once of which needs the Employer to prove to the US Govt that there isn't a USC to fill that position first. If not then the EBx is issued for that process.

 

Now a CR-1 married seeking a family based visa and a K-1 also seeking a family based visa can work once the begin to process their AOS. Once you file the I-765 form and approved you will be able to search and receive work. Official wording below. 

 

After being admitted to the U.S. on a K-1 nonimmigrant visa, your fiancé(e) may immediately apply for evidence of work authorization by filing Form I-765, Application for Employment Authorization. In this case, your fiancé(e)’s work authorization is valid for only 90 days after his or her entry into the U.S.

Your fiancé(e) may also apply for work authorization at the same time he or she applies for a Green Card. In this case, your fiancé(e) can file Form I-765 together with the Form I-485. In this case, your fiancé(e)’s work authorization is valid for one year and may be extended in one-year increments.

 

Thank you so much for your information.. I just want to clarify it would make more sense to file the I-765 and the I-485 together as you mentioned in the second option once the fiancé gets to America right? Because from what I am understanding only filing I-765 and getting 90 days validity would be kinda pointless because what would you do after the 90 days is up ya know?

Yes you file both together and add in the I-131. The fees for the I-765 (EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

Day 215 here. So you’re not alone. Feeling the same way. Trying to stay positive for. It’s me and my fiancé.  That magical NOA2 will all make this seem like distant memory once it arrives.

Yeah im trying to stay positive too since im seeing my fiance next week again, but I am so anxious about being one of the cases that wait over a year and still dont know whats going on :(

Thanks for offering this valuable information. So what about the driver license? When can be obtained? I know it depends on the state, I am in Arizona and when I sent an email to the Az DOT they told me that my fiance can obtain his driver license as long as he can provide proof of legal presence. So which one of things you have mentioned can proof his legal presence. I know it's kind early to think about this topic now since we haven't received our NOA2 yet, but it's just kept me thinking about it.

They added 5 days onto everyone’s accepted on NOA1
