I'm pretty sure OP said they have an interview in a few days, why is everyone talking about an RFE🙄

 

OP, if I were you I'd print Tinder ToS and prepare this Declaration Of How We Met or something, and go to the interview, if you made it to this point, you're most likely fine

I am definitely not the first person in this thread or the first person to say this to them. I am also only referring back to the originally post where @TNJ17 claims “USCIS demands it.” Of course I’m fully aware it is highly encouraged but there is no need to spread fear or tell people that they’ll be outright denied for it.

Should we keep the TOS on the side and only give it if they question it? I think it may not be an issue and I do not want to bring more attention to the topic if we do not have to.

Yes absolutely! I think everyone can agree that it’s important to jot volunteer any extra information. Answer what they ask without spin-offs and give them what they ask for. That’s just my opinion but I think you have nothing to worry about, especially if you have everything at the interview. Think about this: have you heard of somebody being denied because they forgot to send a paper with I-129f? This could have been an RFE or a denial at USCIS stage not embassy stage

and this is totally fine, no-one had an issue with this. it was actually said in this thread that describing how you met was required in the i-129f, and that TOS was a requirement. both claims are false. this is not helpful at all.

Yes, if they ask anything, you’ll be prepared. If not asked, just keep it

This argument has been had many times over the years. 

Bottom line- if its an IMBRA you have to check the appropriate yes box. You also have to describe (IN YOUR OWN WAY) the circumstances of your in person meeting during the 2yr period. 

Some people give a long statement (pages). Some people write one or two sentences. Neither way is wrong. The extent of the description is the prerogative of the applicant- USCIS offers no guidance on what is an acceptable description because like so many other things its up to the officers discretion if its acceptable or not.

 

If you mention a website be prepared to show TOS that its not an IMBRA. USCIS does not care if the site is well known or otherwise obviously not a marriage broker site. They can and have sent RFEs telling the applicant you stated you met online at XYZ website (they auto fill in the blank), please send your IMBRA stuff from them to us or prove its not an IMBRA site.

 

In addition to any policy changes the service centers will periodically and randomly start enforcing or ignoring specific internal policies. People that have been watching for a while know this. The general advice on VJ is to be aware that empty box is your first chance to establish a bonafide relationship if you wish to take advantage of it. Any mention of meeting on a website can result in an RFE delay so include the TOS if a website is mentioned no matter how obviously its not IMBRA when you file.

If you didn’t pay a fee you did not use IMB. Tinder/Facebook are not entitled to IMB. IMB is more of a service, described below:

 

Defined as an entity that charges fees for providing dating, matrimonial, matchmaking services or social referrals between U.S. citizens and foreign nationals.

 

Match.com is even exempt from being an IMB & you pay fee on that site. So don’t worry too much.
