Canadian August NVC spousal visa filers

It makes it more of a challenge to provide additional proof and documents to the re-establishing domicile requirement. But we are working on it and would appreciate any help or suggestions to satisfy this requirement. I have read a lot of comments on different threads on VJ that lead to other articles also about how to re-establish a domicile. I have to go to the RCMP again to get the finger print police check done before we leave for Florida so hopefully it is here when we return. So, that's were we are at now. 

 

P.S. my husband loves the heat but I can only stand it for so long.

I’m in the exact same position but here in Ontario. My wife in American and is a PR. We had domicile issues so we used my brother and sister in law, and they were able to provide all the needed info. The NVC accepted it, so I can say firsthand that it worked. They had to fill out their own forms and provide proof of income and tax returns etc. so, if you have anyone you can ask, that’s the easiest route.

once I submitted my last doc it took the NVC about 2 weeks to say that all was good and accepted and that I was now in queue for an interview. Just for reference sake.

You can try the non-fingerprint route, but just be ready for an RFE

Did you get the fingerprint check under "Privacy Act"?

I did the fingerprints because I was told by my lawyer they were needed, then by the RCMP, then the local police department(who sent me onto the Commissionaires office, then at the Commissionaires office. I have no clue about the privacy act or what it is...I just wanted to get what the NVC requires and be done with this!

And ya, I’ll look and see if I can figure out the dates again, I’ll try to do it tonight. I know that even though I’m almost done, there was a day where I was starved for information and dying to see what everyone else had experienced. I’ll be happy to give what I can. 

 

Again, I was doc qualified on August 6th, that I know for sure!!!!

You need the fingerprint check under "Privacy Act". If you got the regular fingerprint check it would not satisfy the requirements.

They’ve already accepted all my documents including the fingerprints, and as of August 6th I’ve been put in the queue for an interview. I spoke with the NVC yesterday and they confirmed that they only thing I’m waiting for is my appointment, nothing else. My lawyer confirmed the same, so I’m sure that I’m good to go.

 

Prior to the interview I’ll certainly be triple checking everything is still good, but from what I can see on the “ceac” website,  and from what I’ve been told by the NVC/lawyer, I’m good to go apparently

There is a distinction between NVC and Consulate. NVC might have accepted your documents but if you are going to be interviewing after September 10, you'll have to show up with what Consulate website says is required.

I have called NVC and talked to a supervisor regarding this, and I was told what I described above. My suggestion to you would be to order another fingerprint check under "Privacy Act" as well, so you have it by the interview, if not you'd at least have it sooner in case you get an AP because of it.

The final decision of course is yours.

Ok I see what you’re saying. I’m going to look into it and order another one if that’s the case. What’s another $100 at this point(or whatever is costs)🙄

Here's my timeline. I should be getting my interview letter any day now, based on other Montreal interviewees. I've been collecting stats and I've found people get their letters between 5 and 7 weeks, most of whom received it at 6 weeks plus a few days. I'm at 6 weeks, 1 day now.

I see you were July 26th, we are August 6th. You will be one I watch closely! I hope your stats hold true! 

 

We are in the last day of week 5...Monday starts week 6 for us. We are super hopeful for something this month!!!!! 

 

Also, I called the RCMP and they said they were familiar with the new fingerprint/privacy act requirements. They said they were confused as to why the change because it’s an uncertified copy of the digital prints that are currently done.  Her wording was “it’s the exact same thing as the other prints, minus the certification”, so she’s confused because it’s not a certified copy, so it’s essentially ‘going backwards’. She said a certified copy will hold more weight legally than an uncertified. However, that’s whats required going forward.  I’m m waiting to hear from my lawyer and I’m also going to call the NVC as well and get their take, in addition to what has already been discussed on here. If I can save $80, why not!?

I totally agree with you ! I spent part of the day researching on the NVC, the Montreal Consulate and RCMP websites to try & find answers on what to do. My husband sent emails to the Montreal Consulate and NVC asking questions and for clarification that the Certified Criminal Record Check was required. Who knows if or when either will respond.  

The Montreal Consulate website has comments that “New requirements for Canada Police Certificates (required for immigrant visa applicants and some non-immigrant visa requirements) have been posted to the U.S. Department of State website and will be effective as of Monday September 10/2018”

Also my husband called the NVC earlier tonight and a nice man said that “100% Yes” you do need to get the Certified Criminal Record Check”, with finger prints. I also talked to him and explained my 2 visits to the RCMP and he said well if you don’t get it and go to the interview without it then there will be delays in getting your Visa.

My husband then called the Surrey RCMP and requested to speak with a Supervisor. We wanted to be sure when I go back Monday (for the 3rd time) to get the Certified Criminal Record Check that there will not be any issues. The person he spoke to yes we are now aware of this new requirement and that she remembers who I was and she spent the afternoon yesterday on the phone with NVC to clarify the issue as well. After I left the RCMP Detachment,  the Upper Management at the RCMP clarified, yes this is new and I can return to get the finger print Criminal Record Check. 

So back I go on Monday 😡 again. I’ll be glad when this is over.

Called and also emailed NVC to ask question about New Requirement for Police Certificate Effective Sept 10th: 2018-09-07, was advised would take 8 weeks for case number from date received at NVC. (Only took 3 weeks)

Received AOS & IV Bill: 2018-09-18-Email Received

Paid AOS & IV Bills: 2018-10-09

CEAC website shows AOS & IV as "Paid":  2018-10-11 (2 business days) 

IV Application (DS260) completed: 2018-11-01

Submitted AOS & IV Documents: 2018-11-04

Case Complete: 2018-11-09 

Interview date received by phone call and email: 2018-12-17

Interview Date: Jan 25, 2019 at 9:00 a.m. 

Interview Complete: APPROVED ! 🙂🙂

Passport/Visa received at home address in BC: 2019-02-01

Ya there are parts of this process that make you want to pull out your hair!

Good luck! I’ll be curious to see what they tell you about the new Sept 10th requirements and why the uncertified version versus certified...if that even comes up.
