Emergency divorce quetion

Hi, I have a few questions please regarding divorce:

1. its true if I file a divorce I will loose my citizenship that  I got based on 3 years marriage? 

2. How much the attorneys charge for a simple divorce ? no kids, no properties, I do not need anything from my spouse, I will waive everything signed from him during the marriage

3. Can I find a studio for rent in this conditions: I quit my job 2 months ago and  I will have different one next week! I can pay 3 months in advance and have a 4 years rent history

Please help, I was not planning for anything like this, but UNFORTUNATLY I have to do what I need to do

  1. No. You wouldn't even have lost your green card if you still had that.
  2. Depends on the attorney and area...could be in the $500-$1000 or could be a few grand for a simple divorce. In many states, you can do it yourself if it's amicable.
  3. Again depends on the area. Typically a current pay stub and/or several months of rent upfront is sufficient for many landlords, but it's really up to their policies. Look around. Good luck.

Thank you, its  a simple divorce because i'm not going to ask for anything  but its not amicable relationship, so I guess I need to find an attorney, 

hopefully I can find a studio because if I go to hotels I will loose every penny I have, I can stay just 7 days max in hotel

3. depends on the area. a private landlord may be more receptive to it than a commercial apartment complex (at least in my area that would be your best bet)

From a quick search you can not file on line incalifornia. You can complete the forms on line but you or your lawyer need to file them in person at the court servicing your area.  This needs to be done in person with the proper fees. You need to do some research on what you need to do this.

I divorced in PA.  I paid around $3,000 and hired an attorney.  Mine was a little more complicated.  In fact because my ex refused to sign it took two years for my divorce to be final (this too differs for each state).  Since yours is easy you can probably handle the paperwork yourself but if you are unsure check with an attorney.

 

Apartments depend on the person renting it out some do more credit checks than others.  Take your time to find one you can afford.

You should consult with a divorce attorney to understand what your rights are.  Even if both spouses are not amicable to each other, you both may see the benefit to making a fast, clean divorce.  

 

Each state has different laws regarding what needs to be done, how it needs to be done, so I strongly encourage you to at least set up an appointment to consult with an attorney.  After you've done that, you may decide that you are able to represent yourself in the divorce and handle it yourself, but it can be a very complicated process.

 

You can look online in the county you live in to find out the filing fees, how much it is to issue the summons, if the sheriff will have to serve the summons, etc.  That will give you an idea of how much it will START to do this on your own.  If you hire an attorney, my best guess is you'll probably need a retainer of about $5,000 to get the ball rolling.  (That is just an estimate though, talk with an attorney to find out for sure and SHOP AROUND!)

look up self service simple divorce online, In Ohio it took under a month from filing to court appearance and cost under $1000, depends if allowed in your state

How easy or hard your divorce in California ... depends on your ex.   If your spouse is cooperating with you ...  you can use a para-legal (cheaper than attorney) to complete the divorce documents and file in court.   If your spouse is fighting you ... then you will need to get an attorney and it will cost more money.   You can use google:  Divorce Attorney + San Diego  or google:  Divorce Paralegal + San Diego.     You can also find legal professionals who speak your native language - making sure you fully understand the issues about divorce and immigration.   Good luck!
