My fiancé and I have been together for 2 years, mostly online of course.  We have met in person multiple times for a total of approximately 2 months.

He is on the sick, aka ESA(Employment and Support Assistance), their equivalent of disability.  He has ADHD, severe dyslexia and memory impairments.

We are currently in the very early stages of immigration, we haven't even filed with the USCIS yet.

What I am inquiring about is would he still quality for disability here?  Would him being on disability or disabled hamper his chances of coming here?  I'm not even sure how to go about this.

Any help or advice on this matter would be greatly appreciated.

Thank You,

Samantha

If they saw him as a "public charge" (likely to use US government programs) it could be a concern. Make sure you show how you can support him, provide insurance for him etc. to reduce this concern.  Is he able to do ANY kind of work?

That’s not gonna happen unless the disability money comes from his home country. You’re gonna have to financially support him or he can’t come. You’re gonna have to prove that despite his disability you are fully capable of paying all his bills regardless of what they are. Foreigners are not eligible for government aids and if you start your immigration process saying he’ll be filing for disability here too, you will get a flat out deserved denial.

I re-read it after I posted and it sounded like he was just wanting to come here and not work, but there are no options to edit. He can still work but his work is limited.  Working with numbers or secretarial are non-options.  He is still physically fit so he can do factory work and others.  We are not planning on him coming here to live off welfare but I just wanted to know if him being on sick there would hamper him coming here.

Yes, it will hamper him coming here. Unless you can prove you are able to support him. He cannot file for disability here. You may find it very difficult to add him to your insurance too as he has a pre-existing condition. Will you be able to add him to your health insurance policy? You may want to check into that as adding spouse can be very expensive with some plans.

Besides you meeting the income requirements as a sponsor (as some have  already pointed out), he will have to have a medical exam before the interview. I'm not sure about his mental and physical health history,   but here are some things to consider:

You might not be allowed to enter or remain in the United States if you:

• have a communicable disease of public health significance

• lack required vaccinations

• have or have had a physical or mental disorder that causes you to engage in behavior that might be harmful to yourself or others, or

• have a history of drug abuse or addiction.

no he will not be able to collect disability or any kind of medicare/medicaid.

They may be stricter on your income and ability to provide financially and for health insurance.

He will have to pass the health exam(though a disability in and of itself is not an issue, that is not what they are looking for)

Currently, pre-existing conditions cannot preclude people from obtaining medical insurance.
