Just received an RFE for the I485 stating I do not make enough income and to resubmit my supporting documents. Does this mean they lost my original documents. Last year I grossed 71000 adjusted on line 22 of the I-1040 and this year alone I have had 54000.00+ dollars deposited from in earnings into my bank account. The RFE stated I did not make enough above the poverty line which is funny due to the fact that I take home 1100+ a week after taxes and the 2018 poverty guidelines stated I need to make 47,575. To-date I took home 38,500 after taxes from job 1 and 13,865 after taxes from job 2 for a total of net 52,365 with 17 weeks left to go for the year. At the current rate I will make another 18,700 for job 1 and 5,950 for job 2 for a total of 24,650 and if you add that to what I already earn if would be 77,017 net after taxes which is almost 30,000 dollars above the 2018 Poverty amount of 47,575.

 

I am wondering if I should have included my 1040 instead of the tax transcript because looking over the instructions I noticed the following.

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

 

When I went through my original I-864 I noticed a slight mistake should I resubmit a new I-864 or just send the tax forms, w2's, 1099,s ext.. that they are asking for. If I can resubmit the I864 should I include my wife and submit a I-864a with it.

I guess I will send in returns, transcripts and w-2's for last 2 years to be safe

01/27/17 – I-797C arrived via USPS

05/05/17 - NOA2

05/23/17 - NVC Recieve

09/11/17 - Approved at Interview

09/30/17 - Visa in hand

10/17/17 - POE Washington DC

11/11/17 - Married 

01/29/18 - AOS sent via USPS

02/20/18 - TXT and email notification of receipt

09/29/18 - EAD recieved

02/12/19 - Interview Scheduled

Yes, I sent in the IRS Tax Transcripts and I-1040, only thing I did not see was a 1099 since when I sent everything in I had not amended my taxes as of yet. Everything else was sent,. Letter from both employers, 2015, 2016 and 2017 tax transcripts, w2's from both jobs, bank statements for the previous 12 months. Go figure. I will just resend everything again.
