If you don’t have a receipt number when you call the main line - click to get status and click that you don’t have a receipt number.  Eventually you’ll get a tier 1 agent that will help you once you explain what you’re calling about.  They’ll ask for your A number among other questions to verify your identity.

I called USCIS. Only because even tho I have changed our address when we moved (2x in last year) like I was supposed to they still sent notice about doing ROC to our old address which was forwarded couple weeks later to our now old address too. So I called to double check they were tracking the correct one since I haven’t received NOA (given it’s been “only 2 weeks”). First they didn’t recognize my case #. She said it can take up to 45 days. I told her I checked everything and only place where it does give me any updates is the newest web. After that she came back to me and verified who I was. I also asked about N400 while on a Phone with her and she said we can file for N400 while I-751 is pending but they won’t reach decision on N400 until they reach decision on I-751. :) I am hoping NOA comes quickly since my drivers license expires in 2 weeks. Ugh.

Not familiar with your case so some of it is assumption. If you GC has not expired then you should be good to renew your Drivers License. I got mine renewed a month ago and had no complications. And if it has expired and they give you hard time, you can ask them for second level verification.

TN & GA give you driver’s license for duration of your GC/visa etc. So if I don’t have extension letter in my hand they won’t renew my license. My DL expires the day my GC does.

When does ur GC expires?

When I changed my address, luckily they renewed my DL for 8 years (I'm surprised how they did that looking at my GC expiring in just 3 months )

But now, for my job, I would definitely need an extension letter to submit, I'm keeping hopes I should get the letter by Nov 1 (as my check was cashed on Oct 1).. I''l keep checking with them, if i do not get the letter by then, i may schedule appointment to my nearest field office and get the stamp done...

On the 18th of this month. So in 2 weeks. Luckily I am not worried about work since I am on “maternity leave”. I hope you get yours soon so you don’t have to sorry about work. Fingers crossed!

That is ridiculous, I am so sorry. I could start a whole rant about this REAL ID act but I won't go there (short version: this is basically the federal government forcing the states to enforce immigration law which while I get the reasoning behind and won't debate that, it is a really terrible idea because it is impossible to execute properly; states know nothing about immigration law and in attempting to be compliant or "tough", they wind up making these dead-ends for people who are doing nothing wrong and are just caught in the system because whoever wrote the policies simply doesn't understand all possible scenarios).

 

ANYWAY, sorry. First question is when does your GC/DL expire? Second question: I see your husband is military, do you have access to assistance through that? How long ago did you apply for ROC? You may be able to go through your Congressman (to try to kick USCIS's butt into gear) or maybe your state representative (at a minimum, to have someone understand why that policy is probably unnecessarily harsh even if they can't exempt you from it)

Oh believe me, I know. It sucks. I do understand why they are forcing the states to enforce immigration law but it makes things so much more difficult for people who are here legally and doing things the right way. I remember I had a hard time getting DL in TN because even tho I had work permit etc they wouldn't issue me DL without my green card. Luckily the process was really quick. And the DL from my country is now invalid because I changed my last name, I waited for months for them to do it and send me the document I need, my passport expired and I can't get any other document from the US, I would have to travel back to the Czech republic. It's A PAIN. 

 

GC/DL expire in 2 weeks exactly. I guess it's my fault for not filling the ROC sooner, I sent it last month but I was waiting after we PCSed to our new duty station since I had issues with them not changing our address and sending USCIS notice to our old one. I know USCIS comes to military instalations but I will have to find out when/if they come to this one.

You really, really don't. Have they been asking? They are not allowed to reverify the green card (for this exact issue, really). This link is for employers to understand what to do when EAD expires but note this at the bottom:

Generally, Employment Authorization Documents (Forms I-766) must be reverified upon expiration.

 

 


 

 

Also, all you need is a driver's licence and a social security card that does not have the restriction on it (that is Column B plus Column C on the I-9, I am posting a screen shot below).

 

If your Social Security card still has "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" on it, you can (and should) go to the SSA office and get a new one. That is going to be much much easier than fighting USCIS for your NOA1. 

 

But even still. They do not need to and *are not allowed to* ask to re-verify your green card. If they are bothering you about it, take it to HR.

Do you know if I can still go to SSA office to change that? I checked mine SSN and realize it does say “Valid blah blah blah”? My GC doesn’t expire for 2 more weeks.

GC/DL expire in 2 weeks exactly. I guess it's my fault for not filling the ROC sooner, I sent it last month but I was waiting after we PCSed to our new duty station since I had issues with them not changing our address and sending USCIS notice to our old one. I know USCIS comes to military instalations but I will have to find out when/if they come to this one.

Yeah, again their reasons are neither here nor there really, because it is the execution that makes a difference. And the difference between the states is nuts. They should at least be required to have the same standard, and the federal government should help them establish that standard. Like with employment eligibility, as you'll see in my long response to Goldfish above, the guidance specifically says that employers CANNOT re-verify green cards, and the reason is specifically THIS. That expiration dates don't reflect legal status in THIS instance (visas etc often do). So states are going above and beyond what the federal government even requires just because they simply don't get the issues. It is dumb, and completely unfair.

 

And no, this is not your fault at all. There is a window for a reason and you shouldn't be expected to be better than USCIS is just because they're backlogged so that you aren't punished by an unfair (and possibly illegal) law. Anyway, that's my rant.

 

For practical purposes: are you going to need that DL in two weeks?  Maybe call the Military Helpline: We have established a toll-free Military Help Line exclusively for members of the military and their families: 877-CIS-4MIL (877-247-4645). For more information, see the Military Help Line page. I have found it is best to be direct with them, leave out details. Say, my conditional green card's expiration is coming up on (this date). I have already applied to remove conditions. However, USCIS has not sent me my receipt I-797 from the application yet. This would not normally be a problem, but Georgia has set my DL expiration to be the same day as my green card expiration and will not renew it without the I-797. My legal status will not lapse, I just cannot provide the required paperwork to Georgia because USCIS won't provide it to me". 

 

I would also take this to my Congressman and state representatives but I go on the warpath about such things for sport (in seriousness, our DMV messed up with my husband's state ID so badly that I now have the direct line to the DMV Commissioner of the whole state and when we went in for his driver's test, we skipped the line, went right to the manager, who was expecting us becasue after the FORTH time they wouldn't take his green card because it wasn't good enough "proof of legal presence" I pulled every trick in the book and sincerely hope I got some people fired).

December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. You should be able to. The exact individual working may look at the green card expiration date and make a fuss, but I believe they aren't supposed to. Give me a bit to dig into finding a written policy. 

 

For a new employer, this will be the easiest path (because note the lack of mention of I-797 on that list....). But your current employer cannot re-verify your green card, they aren't allowed. Because of this issue.
