Hi everyone,

I have some questions for you guys.

For the previous year, (2006) my income was above the poverty line and I qualify to sponsor my now husband for his permanent residency. However, I am concerned that in the previous years, (2005 and 2004) I made very few money (approximately $4,000 to be exact, kind of funny huh). During these years, I was a full-time college student and my work-study jobs only allowed me to work very few hours each week (hence the low income). Although I now make enough money and fall above the poverty line, I am worried that my low income from 2005 and 2004 will affect my qualification as a sponsor. Now, for my questions,

-Do you guys think that I should have a joint sponsor (for my husbands I-864) although I qualify and make above the poverty level? I am worried that if they see that I made very few money in 2005 and 2004, they may automatically disqualify my sponsorship.

-Should I include my tax transcripts for 2005 and 2004 although I only made $4,000 per year? If I include them, is it a good idea to attach an explanation telling them I was a full-time college student during that time?

What do you guys recommend?

I’m starting to lose it once again (like I did when I filed the I-129F). Also another question,

-Does anyone know when the new fees come into effect? I have tried looking and looking, but all I come up with is some time in June. I am trying to file as soon as possible and I may be cutting it close and having to pay the extra fees. The USCIS website does not have any details about when the new fees will come into effect.

From what I understand (and what I did) you only have to submit the most current year's tax return. If you have your 2006 returns then that is the current one. I also submitted a letter of employment again with the I-864.

Hi ucla... If you read carefully the I-864 form inside in page 8 you can read "You must provide ... photocopy of your Federal Individual Income Tax return for the most recent tax year" so if you like to send the other years IS OPTIONAL.

We only sent the most recent year of the tax return and I think will be OK.

Hi There,

My husband and I were in a similar situation when we filed in April. His 2006 income was well above the poverty line but he didn't make it in 2005 and had $0 income in 2004 due to being a Grad student. Here's what we submitted to cover ourselves:

- 2006 tax return with all corresponding W2's, 1098's, 1099's, etc

- - A letter explaining the shortfall in income in 2004 and 2005, signed by my husband (the supporter) AND University transcripts proving his enrolment during those years

- Letter from current employer indicating position, date started, salary, whether it's full time or part time, potential for income advancement

- Previous 6 months of pay stubs

- Letter from the officer of the bank showing balances in Savings & Chequing accounts, average balance over last 12 months, and the total amount deposited over the last 12 months

I hope this helps you out a bit and gives you some ideas for supporting your case!

You don't provide any information about the nature of your current employment, which might be as important as the amount of money that you are currently making in determining whether or not you qualify.

Note that you have to indicate the income shown on your 2004 and 2005 tax returns on the I-864 even if you opt to not provide copies of the returns, so some explanation would be in order.

You want to make it clear that your current income is solid and sustainable, not have it appear as an aberation from the norm.
