Hi,

Sorry to hear you’re 130 is taking so long. But from my experience with our petition, there is some light at the end of the tunnel. Mind you, the current situation has somewhat stalled the system a bit. Our 130 took 1 year for approval and this was after 2 RFE’s. Like yours, it was also transferred to local office, and then we received RFE for more evidence of bonafide marriage, we submitted evidence and 2 weeks later it was approved. Since you already went to the senator, try congress office. That’s what we did. In the meantime, have you called and asked to speak to tier 2 officer?

We did call and asked to speak to a tier 2 officer but they never let us speak to the officer, there where always an excuse. When I called and ask to speak to the tier 2 they would say it has to be my wife since she is the petitioner. When she called it was always an excuse. We call and call. Our Case is been on the local office for over a year now. Thank you very much.

Your first mistake was hiring an Attorney . Second due to what's happening in the world at the current moment things are a bit slow they'll get you approved soon don't worry.

Why was it a mistake? I really would like to know. Since they are not helping at all

I hired an Attorney to file a CR 130 petition he charged $6,000 USD I filled out the petition and sent it to him to retype I never saw the actual form that was sent in later at NVC stage I kept finding out about mistakes he made .They even used a form that was outdated by 4 years It ended always in arguments over and over they even told us in the beginning that my spouse needed police clearance from everywhere she had lived which was about 15 different places she went about a week on this quest turned out she didn't need any of them just one . It seems he made the mistakes on purpose so we'd get denied  he even got to put his Bar number and signature I found this out right before the interview we could have been fine without an Attorney my advice never hire an Attorney to fill out forms you will have to answer for .

Well at least yours is approved. My wife and I been waiting for over 20 months. We have 2 kid's( 4 and 2 years old)( Americans) they are staying with me in Honduras a third world country. They don't speak Spanish at all. We haven't seen my wife their mother for a year now and who knows how long since the pandemic. So if I where you I would be happy that it's approved not denied. And pray that this new bill doesn't affect us. Since they trying to band new residents visas to enter the US. Hopefully your husband will be reinstated with you this year. I wish you the best.

I believe that's exactly what's going on with us. It's kills me to know that my wife is going through so much and I can't do much about it. Now this new bill that they want to stop green card visas for new immigrants. These are some hard days for us that are awaiting for our I-130

Don't worry from what I've seen K1 and spouses will not be affected just be patient there is always light at the end of the tunnel I nearly let this petition stuff drive me crazy we were approved but it wasn't due to anything our Attorney did we we're finally approved because of my persistence . Also I feel by the time we got to the Embassy the consular was aggravated by the amount of evidence they had to go through they truly just wanted to be done with us .

We don't have an attorney. We fired him over a year ago,What was done,is what we've done and accomplished. Our attorney wasn't doing a thing for us,so we fired him.

I went to USCIS meeting alone,my husband was already back in Australia by then. That's why we're waiting on the National Visa Center
