Hi everyone. I am living abroad with my husband. I did his petition for a ir1 visa in the states while visiting. So I sent my original paperwork to uscis. Anyways my husband had his interview two days ago. He left with a piece of paper that said my domicile needed to be proven. 

 

When I had sent my oringal paperwork I only included a copy of my passport. The officer said that I should have sent the petition from the country I’m living in currently. Any experience with this? He said get domicile proof and send via courier to embassy. He then told my husband that they will continue from where they left off. So another interview? What should I send? Will those papers go back to the Nvc? Should I expect a long process? Thanks everyone. 

Again I’m looking for anyone who has had this or

something like this happen to tell me how long this usually takes. Like do the documents go back to the states or stay in the embassy. Will there be another interview?

They need to know where you are going to live. Proof of domicile is a requirement. 

 

An apartment lease, deed to a home, or letter from the person you will be living in should suffice.

 

The sooner you get it to them (instructions should have been given on how to submit that information), the sooner you will receive an answer or further instructions. It could be a few days or a few months, there is no consistent time frame they are obligated to adhere to.

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Wow that sucks. I just feel awful that I was missing something basic. On the website it just said for proof of domicile a passport copy.

That only proves citizenship.

Not strictly true. The evidence of intent to establish domicile is not because they want to know where you will be living (it’s perfectly acceptable to have no fixed address at this stage) but what is required is evidence that you intend to move back to the USA permanently before or with your husband. Job applications or a job offer, enrollment of children in school or daycare, apartment lease or a statement from a relative that you will be living with them, selling property in the country where you currently are, maintaining a bank account in the USA - all of those help to demonstrate that you are moving as a family to the USA permanently. You don’t have to have a specific address. It’s perfectly acceptable to even live in a hotel for the first days/weeks if you don’t have any fixed address yet. What they do want to see is the steps you have taken to close your ties where you are and re-establish yourself in the USA. If you cannot demonstrate this to their satisfaction, the visa will be denied.

Incidentally, which country is it where you are living? Some embassies are more difficult than others when it comes to re-establishing domicile. Montreal is notoriously difficult. London, on the other hand, is far more relaxed.
