USCIS DROPPED THE BALL

When we had our AOS interview. They actually lost my wife's file in Guam. So we had to wait 3 months after the interview to get approved. Because of the fault of them, not us at all. Sometimes stuff happens, but just be patient.

@SilverMonk same here. This will be our first marriage, no criminal background- I personally went with him and picked up a court/police cert with absolutely no criminal activity. My profession requires bonding so I wouldn’t be employed if I had a crimimal record. No kids, good credit, gainfully employed, pay my taxes, homeowner, I vote,  not on any fed assistance program, I like nice walks on the beach 🏝 lol lol I have to laugh... I don’t know what else they want...

You guys are all correct, horrible government and employees.  Maybe the USCIS is completely overloaded with all the ridiculous frivolous filings that so many people seem to send in and bog down the system. I am sorry you feel you are having to wait too long.

Well you cant just demand that “ I have asked to pull the file out and work ASAP. I will call you personally next week”. You are not alone in this process, so you cant just demand that. They will get to your application, just keep doing service request and follow up. Paying taxes and not having criminal history doesnt make you entitled. Remember, immigration is previledge not a right. Good luck.

@cd37 I used “ “ that means when you’re quoting someone. Those were the exact words used by the officer and not me. Might want to double check before you reply! 

We were talking about background investigation so we were discussing criminal records, etc.....  no one said it was right nor do I need you to tell me this!

Following up was a great idea. We followed up on our EAD application after 140 days and things finally got moving within a few days. However, I do not think it is beyond ridiculous. We all wait long amounts of time. We are currently 15 months into our AOS. Mistakes happen and it’s up to us to stay on top of things. Good luck!

That's not really how the examination of federal applications work, nor is it representative of how federal application case workers work. The case worker might have a union backing him/her making it more difficult to fire him/her, but all workers have performance goals that they have to reach. If they don't reach their performance goals they're put on Performance Improvement Plans just like Private Industry does with their employees who have poor performance. If they don't improve, and have negative performance ratings over multiple periods, management really does pursue separation. If the ee' does have a union behind them, then separation is a longer process as defined in the contract btwn the union and the agency but it's definitely not a blank check for the employee.

 

The situation that the OP describes is much more likely an administrative error, not some lazy case worker fault.

And this is why Trump just nixed a "cross the board" pay raise for every and all government employees (millions of them?)  He wants to go with a merit based system, which is good.  When you get the exact same pay as an under performer, then there is no incentive to do your best to excel in your job to work up the ladder.

The problem is, this doesnt work for all or even many government sections.  My husband's job cannot be performance based, for example.  It is safety based and sometimes that takes longer.

Wow!  Pretty strong words there!  Looks like you got your AOS approved in 6 months. That’s not bad at all. We are 15 months waiting here. I honestly believe these employees are doing a great job and doing the absolute best they can. I do not think, as someone posted here, that some old grouchy guy lets piles of files sit there for days and only manages to do one a day. IMO, these people work very hard and have good work ethics. Their job is to ensure that people that don’t belong here aren’t allowed to stay. As a veteran, I need to say that our government is amazing and I am proud to have served to protect my nation.

I second that. A year ago we inquired with Tier 2 about the status of our RFIE and got an interview scheduled few minutes after the call.

At this point , only thing in your power is to keep making inquires. If there is a consolation, one man waited 3 years before he got his NO2 approval.

This is correct. USCIS service sites respond to congressmen case workers a lot faster than regular people. You might get a generic response back but atleast you know they still have it and are keeping track of it.

I was being sarcastic, ( quote the whole post)lately everyone here seems to be bitching about the process. I think my wife and I were lucky it went so fast. Of course, we quadruple checked everything, sent all the required evidence, all rock solid.. We still had a strange experience of case worker at consulate asking my wife to drop off a piece information at the front gate of the embassy. ??? without issuing a 221. I promptly got on the phone and computer and requested a 221 form because that seemed wrong. Had to be careful not to piss anyone off too or denial ))) 

  I, too; think they are doing a great job in a difficult task. We see so much here (VJ) that leaves me scratching my head. I am sorry the OP is in a difficult situation and some of you are having such a long wait. Wishing everyone a speedy end to the process but glad there is a difficult process
