USCIS DROPPED THE BALL

January 10th filer - Day 234 NOA 2 pending. After two case inquiries and vague replies “case being adjudicated” and several calls “case is being worked on” I made an appointment with my local office. I was hopeful they would shed some light. I had with me a duplicate of my package and proof of two additional trips I took to Cuba 🇨🇺 after submitting our application. Long story short, A. Officer stated, she was sorry but it appeared they had dropped the ball 🏀 I was told “your file is sitting on a shelf”!!! “It’s not even assigned to an officer.” “I have asked to pull the file out and have them work on it ASAP.” “I will call you personally by Thursday.” So Thursday is next week, but now I have to be 5 steps ahead so I scheduled another appointment 09/11 in case I don’t hear back!!  This is beyond ridiculous!! 😡

So sorry to hear this :cry:. I had the same feeling when we have not yet gotten any news about our case. This what we did.

 

We contacted the congressman but we were adviced to wait for 30-45days, we didn’t wait and we can’t for it. So 7mos. Had passed we submitted an online inquiry and received an email of their specific date to respond to our inquiry but still we didnt stop we still keep on calling ang calling and calling USCIS everyday til such time they gave us the update of an RFE over the phone(Aug.13). We also tried emailing the Ombudsman, they replied to our email but we didn’t pursue because USCIS notified us that they already took action on our case.

 

Please hold on... This will be over soon for all of us.. Just Keep the FAITH..🙏

@geowrian USCIS is currently processing February and March applications. My case  and probably many others slipped through the cracks... case inquiries per my comments are service requests.  USCIS supposedly process cases based on filing dates. They skipped mine. My case hasn’t been touched period. I’m quoting the officers statement to me in person. I and sharing to bring light 💡 to others who are passed their deadline. As you stated this is a “human process” therefore mistakes will be made. A lot of January filers got an NOA2 or RFE at the end of July. It’s September now so it’s passed disclosed timeframes.

Not surprised. USCIS is useless. Call all the congressmen and senators you can get a hold of and ask them to inquire. It’s the only way you’ll see progress.

I had something similar happen when I moved to the US with my CR-1. They forgot to send me my green card even though I paid the fee two days before leaving the country. If I hadn't asked them for it, I likely never would have got it. As you said, sometimes people's files fall through the cracks and that's bound to happen due to the volume of cases they get. Everyone has probably overlooked something at their job. Fingers crossed for you, OP.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Sitting on a desk is probably a very accurate status report. You have to remember you could be the unlucky one whose petition is on that employees desk that has 20 years of service in, doesn't really care anymore, and there is no way he can get fired from his job, so he does one case a day just to looks like he is doing something and keeping his job( and has a stack of 30 petitions on his desk). Now, in the next cubicle is the new hot out of training 20 some year old who just scored a cake government job with free medical, and benefits that are the best in the industry, not to mention 20 plus bucks an hour to start, and he is cranking out 10 petitions a day looking like a rock star to his supervisor planning on running the whole department in 5 years. Welcome to the US government. Slipped thru the cracks should be the US government motto, if I had a nickle for every time I tried to get something done by the US government and it slipped thru the cracks I would be retired easy by now.

@Loren Y I wish it was assigned period. Acoording to the officer, my case is on shelf not on someone’s desk. Not assigned period. February and even March applications are being processed.

You are not alone. There are few of us january filers getting left behind. I'm a Jan 16th filer.

My congresswomans office got a reply from USCIS saying it's pending review by an adjudicator and to wait 30-45 days. 

We filed an inquiry and they said they're doing a security check. 

I'm starting to the same thing is happening to you might be happening to us. I'm gonna ask my fiancee go schedule an infopass.

 

Does anyone know how far out the Boston office is for infopass sessions?

@SilverMonk yes I know a few of us out there who got left behind. Those replies are all scripted. I received the same message: applicantion is currently being adjudicated eta 30-45 days. The infopass was extremely helpful because the officer did her research and in less than 5 minutes she said my case was not being adjudicated because it wasn’t even assigned to anyone to review. So those replies are not accurate just to buy more time. Like I said before I understand and respect the process. I have a problem when cases in February and even March are being processed. My case is just sitting on shelf not because of a delay on my behalf or even background delay just fell thru the cracks. So now I must remain on top of my case until there’s movement.

you must sign a release form to have Senator inquiry/  do not be surprised if what they tell u is same thing u have already been told

and when u do an inquiry, it is forwarded to Homeland Security and you can google your name and see it is published in the web

should say it was bene's name 

i was surprised to find it there

Oh no, I understand and totally agree with you. What I'm saying is that I feel like the same thing that is happening to your is happening to mine. Because they keep giving me these cookie cutter answers and I don't buy them. My fiancee and I are in our mid twenties, no kids, no ex nothing, no criminal background, not even parking tickets. So when they tell me they're still background checks on us while Feb filers and people with past divorces, felonies and whatnot are being approved ahead of us, then I know those answers are not tailored to my case and are generic. These cases that are left behind probably get misplaced or looked over thinking they were approved.

I'm gonna ask my fiancee to call on Tuesday and schedule an infopass too.
