Just to be clear, after you file the K1, you cannot get married until that visa is approved.  I assume you mean if you file CR1 visa in january and not that you are going to file K1 and then get married before approaval ?

Yes,  I understand that. Wev are planning to get married the week after it is approved and he has his visa in hand.

Does he understand he will be unable to work and even likely drive for about 6 months after you two file for the AOS?

Until you have residency.  Then you have to change it.  In Colorado for instance that's 90 days.  And depending on state you may have to start from scratch (California for example.)

Ok so I talked to my fiancée and we are both going to do research this weekend and make a decision on Monday between the two visas. If we decide on the CR1 then he will come here in Nov and we will get married and then start the process. We have a tentative date for a church wedding as August 3 2019, I feel now with the CR1 that we can still do that. He can come here and we can do the church wedding in August and then he can go back home. The church wedding is just for friends and family to see me in that white dress, I will already be married.

Thank you everyone! My fiance just called me and told me he did his research tonight,  he knew I was doing mine lol. We both think the CR1 VISA is for us.  We decided that he will come here in Nov or Dec, as I am going to there in October ( my mom will kill me if she can't see me get married). We will get married and start the CR1 by the end of this year! It may take longer,  but I think it will be worth it in the end! I am going to bed with a smile on my face,  feeling like a weight has been lifted.

Aww yay!!!!!! Congratulations! Honestly K1 is technically WAY longer due to AoS. With CR1, yes it means he has to wait a bit more to enter the US but what is 3-4ish months when compared to the prospect of spending the rest of your lives together???

It will make our August 3. 2019 church wedding less stressful too. He will just come for a couple of weeks and we will do the church wedding with my friends and family and then he will go back until we are approved!

It depends on the state you live in. In Georgia, you are required to obtain a driver’s license within 30 days of becoming a resident of the state. That is, if you plan to live in the state on a permanent basis and have a physical address here, you must obtain a new Georgia license as an immigrant. And you can’t just exchange one for the other. You have to take a written test and a road test to get the license.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
