divorce proof for pennsylvania

Hello all,

  I recieved an RFE today and 1 of the issues is me and my prior wife were married in the Dominican Republic in 2009, and my now ex-wife filed and got the divorce in the Dominican Republic in 2013 it was no fault as we had no property or children together. Now the Uscis is asking for proof that divorced is honored in my state. I have been to the Prothonatary and my local representatives office and no one can give me information on where I find if this divorce is valid in my state. I can't be the 1st person this has happened to. Can someone please advise if they have dealt with this and how they remedied this situation. I have already wiated 10 months to get this RFE, I don't wish to wait much longer.

Here's an article addressing this issue.  It's complicated, but basically says that divorces obtained outside the US are not necessarily recognized as legally binding in the US.

You may need to take your DR divorce decree to your local Pennsylvania family court with a certified translation and file an application for your divorce to be declared legally recognized in your home state.  I suggest that you contact a PA attorney who has experience in these matters.  Hopefully you can get this done quickly and get a piece of paper soon to send in and answer the RFE.  Good luck!

Hi. I also received an RFE for the Same reason. I'm still working on getting my divorce decree and certificate apostille in the Dominican Republic. Once I get it, i will get these translated and send copies to USCIS. I was told by a person I know who provides immigration services that by getting these documents apostille, USCIS will honor them. I really don't know if this will work, but i will try it. Were you able to fix your issue? How? What did you send to USCIS to respond to your RFE? Hope you were able to resolve this and I wish you good luck and prompt approval.
