Kym, what's your update? Were you able to confirm the location of your petition and has it been approved? What happened with the scumbag lawyers?

Yes, they finally located our petition..only to find out that it had been closed back in October. We had to then refile and start completely over...so no, we are not approved, not even close to it! (Sucks). Now of course our ex-lawyer is to blame for this for simply doing it all wrong. But USCIS should take partial blame too because they did not either forward it on to the correct service center nor did they return it. And most definitely if they closed the petition, someone should have been notified! We got screwed from all sides.

As for the scumbag lawyer. Darryl and I both spoke to some lawyers looking into sueing him. Well, in order to do this you really need to have at least $35,000 - $40,000 in damages to make it worth your while and come out anything ahead (after all the other expenses). We were told this by about 3 different lawyers. We simply did not have that much invested into the wedding (thank god!). So we took another route and went directly to the head of the lawfirm. We are getting a little compensation, but not what we were wanting. We still lost money, time and a lot of sanity! We still plan on filing a complaint directly against the lawyer that caused this with the Missouri State Board.

Not sure if you remember from my original post about all this but our lawyer had also told us that Darryl could not enter back into the USA for a visit once we had applied for the K-1. Something I found out to be false after talking to all you people on here. Well good news! Darryl made an appointment with the US Consulate there in Sydney and was granted a renewal on his B-2 visa and he got to come for a visit! It was absolutely wonderful, we had not seen one another in 10 months. He just left last Monday (and yes that was sad seeing him have to go back). But it certainly made this wait a little more bearable.

Our new petition was received on February 27, so we still have quite a wait in front of us. I'm just hoping hoping hoping he will be here before Christmas.

06-12-06 - Met with lawyer, filed for a K-1 visa

07-17-06 - NOA1

10-31-06 - Touched

01-29-07 - Found out from USCIS that my lawyer had filed at the wrong service center and nothing has been processed.

02-08-07 - Found out that our petition had been closed back in Oct. 2006. No one was ever notified of this from USCIS

02-09-07 - Began gathering paperwork once again to start all over. Started cancelling our wedding plans

02-20-07 - Filed for a K-1 visa once again

02-27-07 - NOA1

04-21-07 - Originally planned wedding date (had to cancel) :(

05-22-07 - Touched

06-01-07 - Granted a Congressional Inquiry!

06-15-07 - NVC received our approved I-129F petition (I never received an NOA2 via email or snail mail). We are just so HAPPY to finally move on!

06-25-07 - Packet 3 received (but it was rec'd by our lawyer, she has forwarded it on to my fiance in Australia)

06-28-07 - Fiance rec'd Packet 3

06-30-07 - Finally rec'd NOA2 via snail mail. It is dated June 25, same day as Packet 3 was rec'd.

07-05-07 - Mailed back form letter DSL-1076 (Applicant's Statement of Readiness to be Interviewed).

07-05-07 - Just waiting now in hopes of an interview date before APEC

07-13-07 - Received Packet 4

07-30-07 - Interview!!!! - APPROVED!

09-01-07 - Fiance arrives in the USA!

10-06-07 - Getting Married

Wow - definitely file a complaint with the bar. In the meantime, glad to hear you are back on track and especially that Darryl was able to get a B2 and visit! Your wait for petition approval shouldn't be too much longer and hopefully it will be smooth sailing from then on. Best of luck - you two really deserve it!

p.s. I remember that idiot lawyer absolutely guaranteeing that your petition was being forwarded to CSC. Even thinking about all you guys went through makes my blood boil!

Thats the oldest petitions they are processing. Most people get through in a bout 3 months, right now, that means the people who filed in Febuary.

Kym - DEFINITELY file that complaint against the lawyer. Don't sit on it either. There's nothing to be gained by waiting, and potentially plenty to be lost by other unsuspecting couples who end up retaining him to help their cases. Help them!

As for the processing times, as mentioned, are the absolute outliers. It's a cover to prevent too many panicked phone calls from filers starting 20 days after filing or whatever. Click on the "immigration timelines" link at the top of the site, check out the averages there. CSC is running between 85 and 100 days right now. I think those filing via other centers still seem to come in under par, but maybe not. I waited 111 days and I think I'm one of the longer January 07 filers. Things have seemed to slow down lately, but then again, if you thought that bogus USCIS reported time was the calendar to go by - then you should celebrate because your guess should be slashed almost in half.

Of course it COULD take longer, but hopefully not. I really would call to let your congressional office know as well - if for no other reason than, again, it might help them make sure other constituents don't go to this crackpot attorney. Plus in case things slow down later when your materials are in the State Department territory, they'll know your story already (they have a greater ability to help in State Departmentland than with USCIS).

p.s. the real average processing time is 2.9 months for all centers (though VSC is WAY shorter) according to USCIS published information. that's just not what they use on the website. 'cause they kinda suck.

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing
