I posted this elsewhere, but I was directed to this particular forum for more assistance. Here's the situation:

• I am a U.S. citizen; my fiancée is a Japanese citizen and has been living in the U.S. since March 2003 on an F1 (Student) Visa.

• She completed her degree at the end of 2006 summer term and her Visa expires at the end of this August (2007).

• We've been planning on marrying this summer, perhaps early July.

• We both have full-time jobs, working as contractors.

• We have a substantial "nest egg" saved.

• She has had a very difficult time finding a full-time, permanent position because of the employer-based Visa sponsorship issue (i.e., few companies seem willing to sponsor these days, for whatever reason).

• We have been together for 3+ years and have several "bona fides" that can attest to the legitimacy of our relationship.

• We have no children.

• We basically live together but do not share a lease contract (we each have our own place).

• We do not have a joint banking account but would open one if necessary.

So it seems we're to go the AoS route to get her permanent residence status. We haven't been able to find specific info about adjusting her status from F1 to permanent resident, and we're not sure if we need to send in any paperwork before we tie the knot. We're also unsure if we need to do an I-130--the info page here lists forms G-325a, I-864, I-485, in that order. Our plan was to marry, then send all the paperwork in shortly thereafter.

You need to file I-130 and I-485 together in the same envelope to the Chicago Lockbox along with all the supporting forms (G-325A, I-693 medical, I-864 etc). Basically follow what it says here:

There's nothing specific about adjusting from F-1, even if your fiancee's F-1 has expired. The important thing is that your fiancee should not leave the USA until she has her Green Card, unless she applies for Advance Parole and was not out of status for more than 180 days.

I've adjusted from F-1. It was very painless and very fast.

You don't need to do anything before you get married, and you will have to send an I-130 along with your AOS package.
