Good day VJ’ers. Humbly seeking for any of your advice on how to respond to our RFE. My fiancé forgot to tick Question number 37 asking if he had been married or no. USCIS sent us back the original page of the form to fill in the missing answer. 

 

Ticking “No”,  does he need to sign the side of it(NO) and date it? Do we need to submit any evidence prior to him being single? If yes what evidence of singleness we need to provide? 

 

The officer who adjudicate it is mentioned in our rfe, do we need to address her and mention her in the cover letter? I would check it no and include a brief note (signed) stating he has never been married.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

Hi,

 

He can check the "NO" box and initial and date on the side for good documentation practices. You can write a brief description of the error in a responding cover letter to the RFE.

 

Assuming your fiance is the USC since he is the one filling out the 129F petition, if he has never been married before, there is no need to provide any evidence of being single. 

 

It is not necessary to mention the officer who adjudicated the petition. I am quite sure there is record of the person.

 

Only sign where it is stated on all the documents. Take another look over (3 or 4 more times) of all of the documents to make sure you captured everything and signed everywhere where indicated before you send it back. This really is a mild RFE.

Thank you very much. Does he need to sign the The Original RFE letter sent to us by the USCIS?

I agree with the above.  The RFE was about not answering the question, it wasn't specifically about previous marriages.  Just check no and send a little note stating that there were no previous marriages.  That is an easy RFE to answer!  

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

So is there a need to proof if the beneficiary hasn't been married? We are waiting for RFE in the mail and I am guessing it is because there wasn't any proof of my fiance being single.

No proof of being single needed. But I want to clarify something, if a person was previously married, they would have to provide proof that they are single and free to marry, meaning a divorce decree. Otherwise, no other proof is necessary.

If there is no instructions for him to sign it then he doesn't have to.

Thanks, then I have to think of something else that caused them to send RFE :)
