Hi Everyone! Anyone here adjusting from K1 and at San Jose Local Field Office?

I checked the stats here in VisaJourney and the last update from SJ-USCIS office is last July. I am just wondering if our local office is having a major back log.

Thank you for your feedback, it is much appreciated. I had the file all prepared so it was good to compare and put my mind at ease.  I had my interview on Tuesday and we also were not told a yes there and then. The waiting must continue a little longer.

I had my interview on Tuesday in Houston so here is my account of our experience of the interview. We arrived in good time , however we had quite a wait as it was very busy. Myself and my husband were both called through to be interviewed and I was asked for my EAD, marriage license. all birth certificates (we have 2 children together, both children were born in America) and all of our SSN cards and both of our passports. I had only taken my SSN card as I don't think it was requested for anyone else's. I apologised and said that I didn't have them with me. My husband knows his number and offered to tell the officer but he declined and said that he will look it up. I was then asked questions from the form we submitted. The interviewer asked my husband how we met, our address and the birth dates of our children. He was also asked him what my parents names are and if he had ever met them. I was then asked to name the state and city we had got married in, the wedding date and who attended. He asked me the date twice throughout the interview. 

I was not asked to show any of the documents that I had prepared in my file that they ask for, such as the W-2's, pay stubs, proof of joint assets  or photos. 

At the end he did his own photocopies of documents then said that he will review my case and if I don't receive any correspondence from him within the next 2 weeks I should expect to receive my green card within 4-8 weeks. 

The interview was about 20 minutes long, he did not want to chat just direct answers and did not want any paper work unless he had requested it.  I had put some on his desk and he asked me to put it away. 

We had also taken our youngest child who is 5 months old and I was holding him when we sat down , however I was asked to pass him to my husband to hold for the interview. Although the interview itself is not difficult, it is the intensity of it that makes it daunting.

Good luck to everyone who is still waiting. This has been a long journey.

It sounds like you had a difficult guy! you had a tougher time than us, I guess 'they' do so many interviews that it is just another case in front of them, some interviewers seem to have lost sight of the personal side and for us we have our future riding on this interview, when I read reports from the people here on the VJ site some seem as if they have had an easy time and being told at the interview that they were approved along with "Welcome to the USA"!  lucky them.  I did read somewhere that if the interviewer is a junior they have to consult with their supervisor before the case is approved but it was only someone's theory.  I guess you were feeling as we did after the interview a little 'flat' and after months and months of waiting it is still going on dreading each mail delivery in case there is a letter from the USCIS? I am assuming that you have informed delivery from the post office where you live and you have signed up to the USCIS site for updates on your case?

I truly hope the wait isn't too long before you get your Green Card, let everyone here know when you do.

I have a quick question about I-693, Report of Medical Examination and Vaccination Record.

Do I need another I-693 at the interview if I already submitted with AOS application?

I remember the form as of Sep 2018 was valid for 1 year, because it was before new policy update.

As long as you filed withing the validity period you should be fine. Normally if it is an issue it would come up before they schedule the interview.

"4. K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

The medical examination did not reveal a Class A medical condition; or

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27]

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28]

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If the applicant was granted a change of status to V in the United States, [29] the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted."

If you complied with the above and filed AOS within one year of your overseas medical exam date, the I693 and its procedures/policies do not apply to you as a K1 applicant. It does not matter when your AOS interview happens, as long as you filed AOS within one year of the overseas medical exam date (and you meet the above conditions), your medical will never expire.
Submit a photocopy of your personal copy of the DS3025 Vaccination Record with I485 and bring your personal copy to the AOS interview as back up.
Your actual overseas medical exam documents were collected at your POE as they were IN your sealed K1 Visa packet and will be sent from CBP to DHS for storage in your A-file.
Your interviewing officer will collect your A-file for review at your AOS interview or shortly after and confirm that your previously submitted K1 medical exam and vaccinations meet the requirements.

So the two big questions are:

1. Is your DS3025 marked complete? Check the bottom left corner for the checkbox that says "K1 Visa applicant voluntarily completed vaccination requirements"

2. Will USCIS receive and issue you a receipt number within one year of your overseas medical date to have complied with the one year submission requirement?

If yes, you have completed the medical requirements to adjust status.

PS: the "new policy update" was for filing the I693 only. That policy would have nothing to do with you if you complied with the above.

Just got an update for my I-485, application to register permanent residence or adjust status “case is now ready to be scheduled for an interview” ♥️

10/02/19 AOS Package received.
10/15/19 Hard copy NOA received with a notice.
10/19/19 Received I-797C biometric appointment.
11/01/19 Biometrics completed.
11/08/19 Case was updated to Fingerprints were taken and in Process.
11/26/19 Form I-485 "Case is ready to be scheduled for an interview".
01/21/20 I-765 "New card is being produced".
01/22/20 I-765 "Case was approved".
01/23/20 Form I-485 "Interview was scheduled".
01/24/20 I-765 "Card Was Mailed to me".
01/27/20 I-765 "Card was picked up by USPS" expected delivery by 01/29/20.
01/27/20 I-765 "Approval notice letter".
01/27/20 Form I-485 Interview Letter received. Interview Date 03/04/2020.

01/29/20 EAD Card in hand.

03/04/20 Interview was complete but my case must be reviewed.

03/05/20 New Card is being Produced.

03/06/20 I-130 and I-485 "Case was approved"

03/10/20 10 years Green card in hand.

Thank you for your reply. The validity period confused me so much.

Actually I had read before that USCIS would request a new Form I-693 if the case took more than 1 year after the date of the doctor’s signature.

And there were mixed opinions, so I decided to ask here.

 

Let me get straight to the result. Mine is valid for 2 years, because my I-693's signature was no more than 60 days before I filed.

I looked into USCIS website again and found that its evidentiary value depends on when the doctor signed.

Thank you, and actually my field office now is Dallas. I just moved from Seattle recently.

I know it is sort of nerve-racking, especially you have been waiting for more than a year.

Hope you will be having the update soon as well!

Hi!! We're adjusting here in San Jose. Got married September 3 last year and received NOA on September 28, 2018. We got the request for initial interview mail last month (November 12) and the date of our interview is on December 17.
