hey guys. so after that everybody told us to hire an accountant to do our taxes, we did. apparently, he is convinced that we need to file Married separately, since my husband didn't have an income in US. he said that married filing jointly will have to include and exclude worldwide income plus mentioning any interest from bank accounts so he said that I, US citizen, will need to file married separately and my husband will not file since he has been here 2 months in 2018 and no income. any input on that? should we go for it or find another accountant?

I'm no accountant but it seems crazy to give up the exemption for him if his income wouldn't count as taxable. Again I'm no accountant and your accountant I assume is. It isn't someone at H&R Block or one of those other tax preparers is it?

the crazy part is that it is an H&R accountant and after our meeting we called another H&R block office and they had the same advice. file separately. ..

I would not take advice from H&R block. Seek out an actual accountant.

I would have to disagree but I'm only one person. I just filed my taxes and we filed jointly. I was convincing myself to file separately as well but if (me) still in the process of adjustment of status. we have to show we are indeed in a bona fide marriage so having married filing jointly is beneficial to me.

Not an accountant either. My husband did a ton of research and we decided to give our file to an accountant to make sure it all goes well. What he found out on his own:

 

You can file jointly, but you need to figure a few things out. Does he have a SSN? If not, he'll need to get an ITIN.

 

Is he considered a RA (resident alien)? IRS has a few methods to check this. If he's considered a NRA (non-resident alien) and you want to file jointly, you have to request the IRS to treat him like a RA by sending your tax return (not online but actually on paper) and a request to consider him RA. In that case you will have to include his worldwide income, not sure how it works with exemptions. You'll also have to figure out which form to use to include his worldwide income. 

 

Like other people already advised, get an accountant that has the knowledge of US taxes in combination with an immigrant. It's kind of a puzzel and only a few accountants will actually have this knowledge. Tbh, I don't think H&R block is that advanced. You pay a little more for a good accountant, but you make sure you do everything right. Also, filing jointly usually gives you a way bigger tax return then filing single (even if you include his income).

I feel like this is such a newbie question lol, but still gonna ask. My NOA1 has received date September 12, notice date September 18. My case online says 'we received your form ... on September 17'. So what date do I go by? 12 or 17? I would think that once they put it in the system (12th) the clock starts ticking, but I could be completely wrong

Hi @C90 Your priority date is generally the date your petition was received (i.e. Sept 12) as indicated by your first NOA.

2018/08/28 - mailed combo 130/485/131/765 with evidence, omitted 693, used personal checks and USPS priority mail

2018/09/07 - e-notice for received apps (some went to spam), checks cashed

2018/09/13 - hard copies of receipts for above

2018/09/14 - e-notice for biometrics notice

2018/09/22 - bio appt hard copies arrived, with 10/08 date

2018/09/25 - courtesy letter for missing I-693

2018/09/26 - biometrics completed early as walk-in

2018/10/03 - e-notice for "case is ready to be scheduled"

2019/01/31 - e-notice for "new card ordered for production" (EAD)
2019/02/05 - hard copies of notices of approval for EAD and AP

2019/10/07 - mailed renewal apps for EAD and AP (~120d before combo card expiration)

2019/12/03 - got 693 medical exam in sealed envelope

2019/12/11 - e-notification "interview was scheduled"

2019/12/17 - interview notice delivered, 2020/1/15

2020/1/15 - interview in SF, card in production

2020/1/24 - Conditional (2year) green card received in mail
