I failed to mention a 30 year old misdemeanor arrest that was dropped and later expunged.  It was my fault and partially the fault of the company we used to help with the petition.  The governments instructions were very clear.  The company we used was not as clear as they should have been.  Since there are no public records and no possibility of me getting any information, I assumed it was no longer an impediment.  The expungement ordered all records, digital and hard, to be destroyed.  There was no record that I could produce so I failed to add it to the petition.  That was my mistake and we were denied because of the petitioner failing to disclose information in the petition.

My fiance also had misdeameanor arrest that was expunged. We are now waiting for RFE that was mailed Jan 24. I wonder if it has to do with that..we did put the charge info on the petition and included records.

I see you got married  since denial so may I ask now what the process is to get your wife to the states?

We filed the spousal visa and had NOA2 in just 4 months.  We are in the NVC process now.

The important thing that you did and I didn't was disclose the arrest.  I followed the advice of RapidVisa and they told me to answer "no" to question 4a because the charges were dropped and the arrest was expunged.  They (and I) were wrong.

She "can" visit but tourist visas are very difficult from the Philippines.  We decided to save the $160.  I plan trips there every few months so we are OK.  This is actually the longest we've gone between trips...December to April.  This will be my 12th visit in 2 years.

I thought so too, at first. Still could be. But then I saw it's from Cuba and I know their diplomacy is sketchy at best so maybe it was a diplomatic expedite.. who knows.

Congratulations to all our September approvals so far! Praying for a week with lots of September approvals and no RFEs. I'll be in the states from the 11th of Feb - 11th of March, imagine how amazing it would be if my fiancé and I were together when we got the approval. Of course I'd also be happy to get the news before then too! Fingers crossed! :)
