September 2018 NOA2 ----> NVC

They are also checking to make sure that the three criminal questions have been answered. He noted that there are times when the petitioner  will forget to complete those questions and those questions are subsequently missed by the adjudicator.  In both of these instances the case will then be sent back to UScis. He said if one of these things occur nvc would know within the first week of receiving the case.

 

 He also noted that he would be lying to me if he told me that they did not do background checks at the nvc level for k1.  He didn’t go into detail but he said FBI name checks are done at the UScis. I know this issue has been discussed here before @Greenbaumbut it sounds like they are doing something. 

 

The supervisor I spoke w was very helpful. He actually had the power to pull my case and tell me exactly what was going on. He didn’t want to do that unless my case didn’t go out in the batch today as it could take it out of its process. He spoke with me in the morning did some research and called me back in the afternoon. I honestly did not expect him to give me a call but he went above and beyond and actually cared.

Here is where I see the potential grey area. So NVC receives the file from USCIS and they do their quick cross check to be sure that the file has the stamp and the criminal questions have been checked (3 as you said). Here is where I have the disconnect; can we assume anyone who is delayed for 30 or days is getting the "NVC" checks and that is what is holding up ALL cases that fit this time frame? What about those who are received and the case number assigned all within a matter of days? I don't think we have gotten the whole picture but it seems you have determined what your issues were. JMO.

We used the NOA1 date that is on the hard copy. That's what the NVC wrote on the email when they replied with our MNL case number. 

The priority date is the RECEIVED date on your NOA1, that is what NVC states. But, the priority date is not used with the K-1 visa, you could enter any date you want and it wouldn't matter.

Update:

 

After e-mailing NVC yesterday to request that I be updated by e-mail should any changes to my case occur, they've now e-mailed me informing me that my petition has been sent to the embassy and attached an official-looking letter that has our case number and other information. For Manila applicants, I think this is the one that we can print out and bring to perform the medical with.

Emailed received from nvc this afternoon saying case is in transit. Me and fiance both received it.  About a 6 hour difference between ceac and the email.

NVC will now forward the petition to the U.S. Embassy or Consulate in Guayaquil, Ecuador. Please note that the transfer process can take several weeks. The U.S. Embassy or Consulate will contact your fiancé (e)/spouse when they are ready to process his or her petition.

Oh my God. How many security checks are they running? USCIS, NVC and finally the Embassy..

Seems like they don't even trust each other or just waste of tax payers money.

Oh my god. How is it you have to complain about everything about this process? It's too bad you didn't research before you started out. It's a process and it works. But it doesn't work for your timetable. I'm glad my tax dollars are going towards keeping the boogy man out of the States. Just look at Europe. I'm just saying.
