I'm looking at the list of the required documents for our K-3 at http://hochiminh.usconsulate.gov/required_documents2.html and it states:

Birth Certificate of the petitioner (original and photocopy)

I do not have the original of my Birth Certificate, however I have an uncertified photocopy of the original. I fleed the country with my parents a long time ago and we used to live in the rural area in Vietnam. So I do not think I can get a copy of my Birth Certificate from the authority there. Is this gonna be a big problem for us?

I sent my wife uncertified photocopy of my passport and my US naturalization cetificate as further proof of my ID.

I heard that I could go to one of the government branch in Ho Chi Minh City and have them sworn me in for some kind of Birth paperwork. Unfortunately I won't be able to go back there until next year.

Any insight on this matter is greatly appreciated.

You can look at the case of deptrai. He missed the Birth Cert but could pass the interview. You should learn from him.

If you still have time, you can come back to VN to do again the Birth Cert, "uncle Ho" will help you.

I used to do again for my Birth Cert, it was lost in the war. You can do if you have time.

Are you a USC?

If you are, you can apply for an Affidavit of Birth Certificate through your county court or your vital record department in your city/town/state.

In my personal experience and did exactly this route myself:

If you will be in Saigon, take a short trip to the Consulate with your US Passport, request to have an "Affidavit of Birth Certificate" done by the Consular in HCMC. Cost: $50 (3 years back). This "Affidavit of Birth Certificate" will be accepted in place of your original or certified copy of BC.

Remember, not to lose your focus and think "BIG PICTURE" (what and how to get the Visa, not how or what to do to get the Birth Certificate). You are not the first person who lost his BC, this is the way to get around it! Keep in mind, if you LIE about your birth record, there will be consequence to pay if they (US State Dept, DHS etc) find out.

What if you have never had a birth certificate made in Vietnam when born there? What can be done? I am asking for a friend. He has never had one made when he fled the country. Unfortunately for us country folks out in villages in Hue, we don't really get them done when we're born. Thanks for any advice.
