The only thing you can do right now is wait.   It's impossible for anyone to help you until you know exactly why your case was returned.   No need for attorney (unless you get the NOIR and it is challenging ).  It will take a few months to make its way back to USCIS and several more for them to review.

well embassy just told us this in an e-mail inquiry 

''The consular officer has already reviewed the submitted IRS tax transcripts and determined the listed income below the poverty guide lines. 
Our office is also in process of sending this case back to National Visa Center recommending revocation of the petition for not establishing the bona fides of the relationship.'' 

can we do something at this point cuz case is with Us embassy , but honestly i don't know why they are returning to nvc

Not enough evidence of bonafide relationship ...in addition to the tax transcripts they don't feel you gave enough proof of a true relationship.    You can "try" to have your senator contact them for a second interview before it is returned to NVC but if they already sent it back there is nothing you can do but wait.

Now that is a totally different situation.......why did you hide this earlier?    The CO doesn't think your relationship is bona fide......this is much more serious than the income level......

You have a VERY Slim chance of catching your petition before it is returned to the NVC

The USC should get in touch with their elected official ASAP to request a second interview, but be aware a second interview will really only help prove your relationship if your wife attends

Income can always be overcome with a co sponsor or assets. 

 

For whatever reason, they do not believe you have a bonafide relationship, which is a MUCH harder obstacle to overcome.

NVC is the step that reviews income so what is the embassy looking at?

if they only look at taxable income,  and not gross, that could be the issue
