Hey all,

I have a sad story. I got all the way into the consulate and they now want to investigate our relationship. This thing was doomed from the beginning as my wife's family kept putting off the wedding until this July (2007) and we had our interview just last week. To make matters worse, while we had our separate interviews, my wife lied in fear because she was afraid she would not get the visa if she told them that we didn't have sex (our religion prevents us until the traditional wedding is done). It's screwed up! Even all the evidence I put forth of all the conversations, email and texting for a complete year and more didn't work. I'm so afraid they're going to deny us the visa.

My wife actually busted out in tears during the interview as they lady was stating that they were going to investigate and they can’t see this as being a legit marriage. I'm not sure what else to do. I'm tempted to send them an invitation to our wedding on the 15th of July to see if they'll accept. My wife and I went as far as going to the President's advisor in Guyana (highest priest) to get a written letter of evidence stating he knows us both personally (he does know our families and who we are) and knows we are not doing this for a business deal. I submitted the letter that same day before I left to come back to the US.

Please help!!!

I don't see a timeline. You refer to her as "wife" but mention only a marriage in the future. Please fill in the blanks.

Sorry,

We first met in August of 2005. We've been legally married since March 16th, 2006 in the country of Guyana. I started the VISA process about April 20th, 2006. After doing so we had sort of an Indian engagement and planned to do the wedding that August but it got pushed and pushed and pushed off by her family and now that they finally decided on a date which is in July of this year. Although we've not had our traditional wedding yet, we both wear our rings proudly since the day we got legally married.

I forgot to mention, the consular stated they'd get back to us in two weeks from last Tuesday. I hope to hear from them soon. I'm just wondering what I should do until then and what I should do if they deny us the Visa.

No NOID or NOIR paper. They just stated they have to investigate further and would be in contact with her in 2 weeks. I asked if I had to come back or if I should stay in the country and they said no.

Did they give you a 221g with a request for additional proof?

They gave us nothing when, said we could leave and they'd be in contact with us. I asked if they were going to give us any paper stating anything and they said no. They kept our marriage certificate, birth certificates of us, our parents' birth cerificates and a picture album of our engagement.

Hi all,

Just wanted to give you guys an update. I went into the embassy after my wife and I had our traditional marriage on the 15th of July. I then went into the consulate this past Friday to inquire about status and to inform them I had new evidence (photos of the wedding). They made me wait for an hour and called me back up to tell me they'd look at the photos and to have a seat. They called me back up a 1/2 hour later and told me they were mistaken and they couldn't look at the photos. They stated for me to leave the photo's with my wife and they'd contact her as I was leaving the country this past Sunday.

I emailed them yesterday and this is the response I got from them (see below). Not sure how much time I should give them before I take it up with an immigration lawyer.

Please be informed that this case is pending Administrative Review. New information when available will be communicated to the beneficiary in writing. We are unable to provide an estimated wait time.

It's been awhile and I just signed back on to give an update. It's been well over a year and here is the latest news!

So last year, I inquired over telephone a few times as well as wrote a letter to Vermont. When I called I was able to speak to an agent who got the DHS to send a letter to me with an update, however it pretty much stated, "we're going to get to it when we get to it."

I inquired again in October with a letter to Vermont Service Center and got no response at all. I then did some more research online and followed up with a letter to the OBUDSMAN down in Washington around November. I did receive a letter back from them at the beginning of December that they had received my letter and were going to follow up for me. So, today I received a letter from DHS, here is what it says...

"This courtesy notice is to advise you of action taken on this case. The offical notice has been mailed to the attorney or representative indicated above. Any relevant documentation included in the notice was also mailed as part of the offical notice." Then it goes onto state, "This is to advise you that we have reaffirmed our previous decision on the above application or petition which the Department of State had previously returned for review. We have forwarded the case back to the Department of State for action."

So, I get on the phone with my lawyers office after I fax over the letters that I had received and they stated that this means that they have approved the request and they are sending back information to my lawyer on how to proceed.

For some reason, i'm still having doubts and in dis-belief unless i'm just mis-understanding... what do ya'll think?

it sounds very promising. I will keep my fingers crossed for you. Good luck, and please keep us updated. How did you get them to review your case? February, I am going to the embassy in my SO's country, trying to see what I can do too.
