I agree.  I would be greatly surprised if this one results in an RFE......i really don't understand how petitions get sent with zero evidence.

To be fair, I sent my petition with very close to little relationship evidence. That shouldn't be an issue for the I-129F stage, although frontloading with the OP's embassy/consulate may be wise.

Lacking other types of evidence that is actually required (i.e. evidence of meeting in person, evidence that they did not meet via an IMB, etc.), is another issue altogether.

Hello members..

I only sent the i129f application forms without any evidence. I know.. that was stupid of me.. my question is.. can i send the evidence now since from Sept 11 they won't be requesting RFEs. My case was transferred to CSC. I was thinking of mailing the evidence to the centre. Any advice???

What did you send with I129f application?

But if the individual did not include any type of evidence with their petition then it will be denied. This is the exact kind of thing that the new directive is trying to curtail.

This not not true in every case. My friend sent a cr1 for her husband with only the required documents and no supporting evidence. I told her for sure she would at least get an RFE. Not only were they not denied, they didn't get an RFE. She did send evidence to his interview at the consulate and he was approved.

i dont agree. Of course better way would be send evidence but it is not end of the world. It may depend on country... but we havent put any additional evidence than needed And were approved. As many many others... some lawyers even reccomend to send additional docs to NVC so the consulate see the file before interview...

Depends on what evidence you're talking about. We kind of get the impression that OP didn't send ANY evidence, meaning no evidence of having met face to face at least once in the last two years. That is an absolute requirement for the i-129f process. So yes, OP will have issues with that one if s/he didn't send that type of evidence. Question is just if it's going to result in an RFE or denial. Likely denial, but some people are lucky.

Why did you decide to send it in without evidence?

My assumption (maybe incorrect) was that a bare form was submitted.  I certainly agree that minimal documentation is required for an I-129f.......Thanks for clarifying.

I agree that people are being pretty harsh on the petitioner.  People make mistakes.  The instructions are not super clear, some people's first language isn't English, and sometimes you just have a momentary brain glitch.  Yes, it will likely be a costly mistake, but I'm sure the petitioner feels badly enough already, there's no need to pile on the judgement.

OP:

If you sent no evidence of any kind, then I suspect you will get denied.  Have you received your NAO1 yet?  They scan all the documents when they first receive the file, so if there's no evidence included, you might get denied immediately.  I know they deny petitions immediately if the petitioner forgot to sign them.  If you have your NOA1 already and have your receipt number, then yeah, send your evidence--what do you have to lose?  Just don't send any originals of anything that you would need if you have to re-file.  If you aren't denied immediatelywhen they receive your file, if I were in your shoes I would cancel the petition and re-file.  It'll cost another $500 bucks, but it's better than waiting 7+ months to end up being denied anyway.  I highly doubt they would send an RFE if it is lacking all the necessary evidence.

Lack of English? The USC is supposed to fill most of it out. They're the one petitioning you.

This doesn't apply to the K-1 process since the case is only at NVC long enough to get a case number then it is shipped to the embassy/consulate.
