I am a US Citizen; my girlfriend is currently working in the US on H1B visa. We have been in a long distance relationship for almost two years - I live in Nashville and her in Chicago. 

 

If we get married and try for an adjustment of status to get her a green card would it prove problematic for us to prove a bona fide marriage? We wouldn't own any joint property, file joint taxes, or even live at the same address for some time.  We do have plenty of pictures together.

If you guys got married, will you guys move to a house live together then?

  • (Day 40) Jun 25 2018 - Courtesy letter for I-693 (Report of Medical Examination and Vaccination Record) received
  • (Day 61) Jul 16 2018 - Case status of I-485 changed to "Case is Ready to Be Scheduled for An Interview"
  • (Day 64) Jul 19 2018 -  Case status of I-485 changed to "Interview Was Scheduled"
  • (Day 71) Jul 26 2018 - Interview notice received (Interview scheduled on Aug 23 - 9.50AM)
  • (Day 99) Aug 23 2018 - Interview approved on the spot! Yay! 🎉  I-485 status changed to “New Card Is Being Produced”,
  • (Day 100) Aug 24 2018 - I-131 & I-765 status changed to “Case Closed Benefit Received By Other Means”
  • (Day 107) Aug 31 2018 - I-485 status changed to “Card Was Mailed To Me”

Other couples who live apart have managed to get approved for permanent residency. You can search for similar threads on here and read how they went. You'll have to provide LOTS of other evidence to make up for it: travel together, proof you've met each other's families and social circles, regular visits to each other. You can still add each other's names to bank accounts. Once married, you do have to file taxes together but either as Married/Filing Jointly or Married/Filing Separately. In both cases, the tax returns can also be used as evidence. You'll have to get creative with your evidence and make sure to document as much as possible. It's not impossible.

I would say get married first, let her try first finding a place to do H1B transfer.

It's better to have your marriage more than 2 years long at the time of the interview or even the time of filing application.

If that doesn't work, file AOS and then quit the job and move in together. It'd only be 4-5 months for her to get the new EAD and she will be able to work for anyone.

If she can find a place to do H1B transfer, then that'd be perfect for you two.
