Is unemployment of intended immigrant a potential reason for K-1 Visa denial?

Hello everyone!

 

My fiancee fell into some difficult times 4 months ago when he was laid off by his company.  He is from Benin but residing in Ghana (and has been since 2003!).  He is a mid-level career professional with 8 years of experience in sales and marketing in the IT sector.  He has been with some great companies up until he lost his job.   My question is, will this create a "risk" when he goes in for his interview in October.  Would this be a reason for denial? In the meantime, we are desperately seeking another position he can jump into and excel at.

 

I am doing quite well financially as the sponsor, living in Chicago.  Still I like to feel like we have an impeccable application presented when the time comes.  I'm open to informed feedback and guidance.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

No they don’t care about his job. For most of us with our other half coming from a poor country -they would be lucky if they ever had a job never mind a good and steady job.

The USCIS has nothing to do with the beneficiary that he's not working but you as a sponsor.If everything goes well in your side the beneficiary will be ok during the interview.It's better to make sure that you have all the evidence and documents that can proves more eligibility..

Thank you everyone for your feedback!!  I'm always impressed with the support you can receive through this feed.  Good news, however, he did find another position in Takoradi!!  I'm very very happy for him (you know how much a job gives you a sense of purpose!).

 

Thank you all again.  Now we wait patiently for that NOA2.....
