i130 rfe

Hi All,

 

I need some help. I received an RFE, requesting my husband's i-130a, which we did send with the i130 when i applied. Everything is filled out correctly. The only thing is he did not sing it, which the form says he does not have to if he lives outside the USA, which he does. Should I have him sign it and mail it to me to send to USCIS?

I got the same kind of rfe if he not in the country a signature is not needed

I would suggest giving the service center a call to understand what you are missing.  If the signature is the issue, then Tier 2 is where you need to go.  That is my 2-cents.

You cannot call the service center.  You can only call the 800 number.  You could try dealing with it by phone, but you can also simply reply to the RFE directly and explain in writing that your spouse was not in the USA when the I-130a was filed, then include a copy of the page of the instructions highlighting the section you are referring to.
