I would agree to some extent. 

 

Perhaps it's the social scientist in me, but situations like this (parents finding it difficult to visit their own children) really do highlight how highly ineffective the US immigration/visa system is. It's as piecemeal and broken as the US healthcare system.

If it wasn't so easy to abuse a tourist visa once obtained, the issue with immigrant intent would likely not be too prevalent. It would likely be closer to how most VWP countries function, in which tourist travel is fairly simple.

Unfortunately, as a result of overstaying have such a minimal penalty - if any (i.e. those who eventually find a way to stay legally) - it has become increasingly difficult for individuals from non-VWP countries to visit.

I'd be all for opening up the tourist visa system and even having a "parent visa" to visit and such, if they could get a handle on the existing abuses of the system. Parents should be able to see their children.
