May i ask what your age difference is?

And correct me if I’m wrong, you had a K1 approved From a different partner correct?

Answering to your question you two have to talk it out on either a CR1 or K1. Keep in mind any of the two requires lots of genuine evidence

Im 36, he's 43... Tes different person!!!

That’s alright then. I was asking because you previously had a relationship with another person from the US. You need to keep in mind they could suspect you are really eager to get to the US. Whatever you do as I said before make sure you have lots of genuine evidence (and I’m not talking about receipts of gifts, they count nothing) and get him to visit you again before you get on this journey. You don’t want to accumulate as they call it here - red flags-

Good luck to u x

It is the same as I say, what better after a second visit ... In my country it is normal to use that type of receipts as evidence, for example he sends me many flowers to my place of work ... Thank you for your advice. ..

If I knew where you worked I could send you flowers. What would that “prove”?

My concern is that the first item you listed as your evidence of a genuine relationship was money receipts. If someone asked me before I moved here what evidence I had of a genuine relationship with my husband it would be the tickets when I flew to see him, the time we spent together, the conversations we had, the poems we wrote, the art work we did together. I’d never consider sending money as evidence that the relationship is genuine.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

It doesn't really matter if money receipts and things like that are accepted as evidence in your country. You're applying for an American visa and the officer who will interview you works for the American government. The American government doesn't accept those things as PRIMARY evidence of a romantic relationship. What they do accept as primary evidence is that you and your loved one have met face-to-face a few times. Lots of people meet online these days so it's even more important that a good amount of face-time happens before filing.

only the petitioner can withdraw a case, though it would have died on its own by now.

i would expect a lot of questions about that relationship and tighter scrutiny of your current relationship.

The more actual face time you have together, the better it is for multiple reasons.  Having said that, you might want to look at this comparison:

K-1

    More expensive than CR-1

Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)

Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)

Spouse can not work until she receives EAD (approx 3-4 months)

some people have had problems with driver licenses, Social Security cards, leases, bank account during this period .

Spouse will not receive Green Card for many months after Adjustment of Status is filed.

CR-1

    Less expensive than K-1

    No AOS required.

Spouse can immediately travel outside the US

Spouse can start work if desired

Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US

Spouse  has legal permanent Resident status IMMEDIATELY upon entry to US.

All-in-all, the CR-1 is superior to the K-1 imo.

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

______________________________________

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Safe to say whether you choose for K1 or CR1 .. you guys need to see each other at least 1 or 2 times more or the whole thing could be a waste of time and money without ending together

I'll repeat again... Not all embassies work in the same way... In my country when u go to consular appointment the receipt of money is often requested as evidence!  We don't have only the money and flowers as evidence!
