Need advice for K1 or CR1

Hello, I need your advice please ...

I met a guy online in September 2017, he comes to meet me personally now in September 2018! He has told me many times that he is sure of what he wants and that we are already investigating what kind of visa to use if everything goes well ...

We have a lot of evidence of our relationship such as money receipts, flower receipts sent to me, online purchases, calls, messages, etc ...

If in his job allow him back in Nov 2018, if not possible February or March 2019 ...

It happens that in June 2016 I had an approved K1 visa petition, but I never made an appointment because the relationship ended. I started the cancellation process of the case and I have a copy of the file letter ...

Also in March 2018 I applied for a visa to see my sister and she was denied ...

What kind of visa should we use? K1 again though I had a oh a CR1 ?? 
He wants to send the package to USCIS in October if it is possible with only one visit, although I prefer that he does so after his second visit

I do not know where I placed USC ... Dominican Republic, different petitioner ...

Right now, I think you two should focus on making 1 or 2 more visits to see each other before filing anything.

Well.. money orders or online purchases aren't the best evidences of relationship. It can be seen as "buying" a partner. 

 

There are plenty (and I mean plenty) of posts comparing cr1 to k1 visa. So please check that before you ask questions. 

 

Anyway. Nothing will happen until you meet in person. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

those things prove nothing other than someone spent money. that does not prove a bonafide relationship.

 

if you are married, you would file a CR1. if you are NOT married, and engaged, you would file a K1.

 

Your denied visa will have no effect on either a K1 or a CR1.

 

The meeting requirement is once within 2 years of filing. However, only meeting once will bring added scrutinty to your case  and some consulates will not look kindly on it.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

In my country it is normal that you put as evidence the receipts of purchases (gifts) from the internet ... Like a perfume, a necklace, nothing out of this world ... 

I know there are many post but my case is particular ...

It is the same as I say, what better after a second visit ... In my country it is normal to use that type of receipts as evidence, for example he sends me many flowers to my place of work ... Thank you for your advice. ..

CR-1. It is cheaper overall, takes just a little longer than the K-1, and you get a green card right away after you move here. The only reason to get a K-1 (in my opinion) is because it was previously much faster. That is no longer true. 

 

The only reason I would consider the K-1 is IF it is a real pain to get married in the DR. In some countries, getting legally married to a foreigner can be a bureaucratic challenge. I do not know anything about getting married in the DR though.

its really not 'particular'. gifts and money spent do NOT constitute a bonafide relationship in the eyes of the US Government.  they might be customary in your culture, and thats fine, but the US government does NOT care about it. 

 

I can count on one hand the number of gifts I've received from my fiance or gifts I've given him in the 3 YEARS we've been together.  And NONE of those items mean ANYTHING to the government.

 

We do however have 40 documented visits to see each other, joint accounts on some things, photos spanning 3 years, a will and POA,  attending family functions together,  etc. THOSE are the things the government CARES about. What he gave me 2 years ago for xmas is not one of those things. Heck, even my engagement ring they dont really care about and we did not submit anything regarding it.

Marriage here is easy, fast and cheap!!! Even having a party is much cheaper than in the USA ... Thanks for everything!

In my previous petition I included all the aforementioned, I was approved in 2 months ... All the consulates are not the same ... In fact here they ask for the receipt of sending money as evidence! Good luck..

And correct me if I’m wrong, you had a K1 approved From a different partner correct? 

 

Answering to your question you two have to talk it out on either a CR1 or K1. Keep in mind any of the two requires lots of genuine evidence
