Hi guys...

Well, I have a few questions:

 

1) Does the age of the sponsor for support matter? I mean.... let's say for example my grandmother (87) says she will do it. Will that not go over well? I hate the thought of having to bother her with this at all. My original sponsor idea may not work (but this could be only projected fear, I am a huge worrier). Yesterday I asked a family member to be sponsor, and to be honest it was an eye-opener for me. It may actually not go as I hope... and I absolutely do not blame anyone. This is a big commitment for the sponsor. I should have asked said person before even applying for K-1 to be fair so I would know. However, I honestly had my hopes on receiving a permanent teaching job this fall. (I'm a substitute now and I earn under the 125% mark with my dependents and I don't have enough equity in my home to make a difference). I know that I acted hastily and I may pay the consequence for that now. I'm ready for you to throw on the heat for that one.

 

2) USCIS says the following: "When you sign the affidavit of support, you accept legal responsibility for financially supporting the sponsored immigrant(s) generally until they become U.S. citizens or can be credited with 40 quarters of work." I am aware of the Adjustment of Status taking about two years to get an interview for that. I am aware you file form I-485 to get that started. I am aware that I must earn 125% of poverty for that to work out (but my best girlfriend just had her interview with husband and they combine both incomes which is great!). I read that you must have a Green Card for 5 years before becoming a U.S. citizen. I guess my question is.... is the Green Card issued after the passing interview? So in essence, the sponsor is not responsible after either route:  U.S. citizen (7 years+) versus 40 working hours  (10 years of full time work)?

 

3) If we are denied our our K-1 because we do not have a sponsor, I will marry my fiance in Turkey. We will do spouse visa -CR1 and just start the waiting all over again. I am curious about my working habits at that time. If I was to work in Turkey for a year how would that effect us at an interview for spouse visa. I have heard that it is very difficult if you stay with your fiance in their country and work versus if you stay in U.S. and work.

I don’t think she matters in terms of sponsors..I’ve never heard of that but maybe others may have more insight. 

 

Soon to be spouse can apply for citizenship after 3 years of being a permanent resident- sponsor will be off the hook after the person becomes citizen or works 40 quarters (10 yrs)

 

I’m not completely sure on how it would work if you stayed in Turkey and went the cr1 route if needed but I believe you would have to establish residence in the US..you would also have to make sure you pay taxes on what you earn out of the country and will need to continue to show proof of financial support. 

 

Im sure others can comment on those things I’m not 100% sure about. 🙂

Whoever acts as a co-sponsor would be signing the I-134 at this stage.  As far as I understand (you may want to research this further), that would make them responsible for your fiancé until you file for Adjustment of Status, at which point you will have to submit I-864, which is the more serious affidavit and would replace the I-134.

 

This may help you reassure a con-sponsor, and buy you a few months to either increase your income before filing for AOS, or procure another co-sponsor for it.

If you had a concrete job offer in hand in the US, the consulate MIGHT accept it. But as a substitute, your hours would likely be too variable, especially with school breaks.

Well yes there are breaks . That is the nature of school. Substitutes work every day here in my city. 

What I am asking is this "what does the officer expect?". If I lived in Turkey and worked for 9 months then returned and became a substitute again here I just would like to know why this is not acceptable, not just that it won't work. please tell me what exactly he or she wants ? I cannot fix what I don't know is broken.

why will it only be a "might" as acceptance?

your annual income has to meet the requirements, which will be 125% of the poverty level for the household.

 

If there is ANY doubt in the CO's mind that you MIGHT become a public charge, expect to be required to obtain a co sponsor or face denial.  It is, essentially, their judgment call.

 

Every consulate is different, and some are much more stringent than others. I am not positive, but i imagine, turkey is a difficult consulate.

Turkey is quite a reasonable consulate to be honest .

so... I guess I'm being an airhead.

Currently we are going through k-1. The sponsor I chose may (may) not work out now. I'm just being paranoid perhaps.

so I asked these questions wondering what my options would be.

i was thinking that didn't apply because we were married 🤦🏻‍♀️
