Hi Guys, 

 

My situation is as following: I got married last year and received my conditional green card im 8 months into it. 

My parents are staying here on a tourist visa to help me with baby. Can they stay till i get my passport or would that make them ineligible when i apply for their green card later? Can they adjust status later here ?

Please let me know thank you

So.. you want your parents to stay illegally in the US for two more years? So what if they get deported? What if they need to go back and can't, because they will get banned from the US? What if they want to find jobs but can't?

 

And no. Illegal presence is only forgiven for spouses of USC.

Hire a babysitter.

Do you mean "American passport"? Because that's going to take years. If your parents are here on a tourist visa, their allowed time is only MONTHS, maybe even weeks. So they will be here illegally and you want them to be here illegally. If they stay, they can immediately say good-bye to any hope of future green cards.

Okay everyone calm down lol. It was just a question i needed clarification and thought of asking here. Got the answers thank you. 

Yes i meant the US citizenship im eligible to apply by September 2020 to get the passport.

As stated earlier, helping with a baby is considered unpaid work, not allowed on a B2 visa. 

 

But yeah, as others have noted, your parents should leave the US by their i94 expiration. Once a US citizen some time in 2021, you can petition them and they interview for an IR5 visa in their home country. They should do things the right and legal way, and that is IR5 Consular Processing.

Well, your question is about an obviously illegal situation, which is taken seriously both on this site and in real life by actual immigration officials. I'm not sure what you thought we were going to say. That your parents are totally allowed to stay in the US for as long as they want without any negative consequences?

  By the time you get a US passport there may be no sponsoring of parents for a green card , if they overstay their visa they may be setting themselves up for a future where they will never see their grandchildren.   Be glad they have a visitors visa , use it as such and make trips as they can.  When you get your USC  and IF there still is a class for parents of a USC , then you can have them here more permanently.  By the way , this site is monitored by immigration and they can tie your posts to you.  

This will not be over quickly. You will not enjoy this.
