I would say, in this case, that they have enough information now to know their original plan is fraudulent.

 

We do not know what they asked USCIS on the phone, but the OP should now follow the law and do things correctly.

 

I'm not a lawyer, and you don't work for USCIS. Let's hope that the worst case scenario won't happen to her husband and they do the right thing. Regardless of that memo, we don't need to make people scared of asking questions.

You asked for proof of what I stated and I gave you proof. Yes, OP knows their path is filled with obstacles and members are here to educate - EVEN if the information relayed is not what the OP wants to hear. Immigration is not filled with butterflies and rainbows and I am not here to cushion anyone's feelings.

I'm not assuming anything about you. I thanked you for the link and went on to offer some kindness and words of wisdom to the OP. Being nice doesn't cost anything. The process is hard enough, so why add to their stress?

~~Thread locked to further discussion. As mentioned by members it is fraud to enter the US with intent to AOS.

Also mentioned it is a TOS violation - Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.  If the OP needs help starting the  spousal visa process a new thread for that discussion may be started.~~
