Tricky Possible Employment Situation, K-1

Timeline

Hello VisaJourneyers,

 

My fiancé is soon going to be entering the US with his K-1 and we plan to be married no later than Oct. 13 (but hoping for a Sept wedding!) He has the opportunity to work a gig with me that begins early January. The tricky part is that the gig involves working on a cruise ship (but not working FOR the cruise line - it's a land-based American company.) Since the ship will leave the country, obviously we will need to have his advanced parole in order, as well as the work permit/green card.

 

Looking for some answers to see if this will even be possible before January 3rd. I doubt we'll have everything in time for this to legally happen. Can the company do anything to expedite the process? Any input is appreciated.

NOA1 - Dec 12

NOA2 - June 29

Visa in hand - Sept 22

POE - Sept 25 

Marriage - Oct 6 🥂

@vaksurik How long is your anticipated ship tour? If your fiancé is away from the U.S. less than 6 months he will be ok, doesn't need advanced parole. Frequent and prolonged absence from the U.S. may jeopardize his future citizenship application (even with advanced parole).

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

Even with an expedite, that's a tough timeline...it could take weeks or months still.

Thanks, it's good to know an expedite is possible at all. We'll see what they can do!  Hopefully we can make it work, but I'm very skeptical as well. 

 

It's only a 6-week gig, which is nice, but it's 6 separate cruises, so that's 6 entrances and exits to the country.

@vaksurik USCIS is very slow nowadays. I see you are from New York. It is impossible to even schedule an InfoPass appointment here in NYC!

Oh great, more waiting to look forward to 😅 Is it possible to schedule these appointments in other cities/states? My family is from Ohio and I travel there frequently - do you think it would be easier to go through everything there, or would that be more trouble than it's worth?

It will depend on the persons adjusting/ applying residence address. If you don’t live in Ohio you can’t just put that as the address.

k1 applicants are not allow to apply for SSN even and without SSN he is not able to work.Nowadays EAD takes atleast 7 Months according to USCIS Guideline.

He already has a SSN from a previous visa. Does that speed up the process at all?

K-1 entrants with current status (meaning within the 90 days from POE only) are aliens authorized to work* and therefore qualify for an SSN. However, to actually work they also need an EAD as required evidence of their authorization to work. This is noted on the SS card they receive.

Inaccurate information. K-1 visa holders are allowed to apply and receive a SSN within 90 days of arrival.  On the card, it will say "Valid for work only with DSH authorization" which means their SSN can only be used for work when they provide an EAD with it.
