Hey all so i know you are able to get a tourist visa if ur lucky and truthful and the officer is in a good mood. 

My question is, if i go for an interview for a tourist visa to see my fiancé while we wait. 

Would they be able to see there is a K1 pending slash already approved if i do not mention i am on one or will they see the k1 application regardless. 

 

Iv wanting to go on a holiday before i come back to SA and go ahead with the k1 process just not sure if i should tell em and hope he or she is nice n approve me or if i should just shut up and say nothing??

 

any advise. If they will knw or not

yes they will know and even if they DIDNT ... omitting it is the same as LYING and is a bannable offense.

 

in many countries, obtaining a visitor visa is near impossible while in the K1 process. you have to prove without a smidge of doubt that you ARE returning and prove those ties. im not sure about South Africa.

Officer:  "What's the purpose of the trip"?

You:  "Holiday".

Officer:  "Who are you going to visit"?

You: "My Fiance".

 

You only have to answer questions they ask......but you must answer truthfully.  They might not see the K-1 in their system, but they will ask enough questions to know.........they are smart..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Know only do they know. Sometimes that ask questions to see if what you tell them align with what they know.

At the end of the day, you just need to make sure you can strongly support any ties you have with your country to prove you will not overstay the visa. Fiancé or not, K1 or not. Work commitments. Lease/mortgage. Etc. It is possible they will know you have an outstanding K1, but even if they didn't - still answer the questions truthfully. Just answer the questions given, though. Sometimes they will outright ask with who/where you are staying - my husband got that a couple of times when he was still visiting me as a tourist.

I dont plan on lying at all just dont wanna walk up and be like id like to visit my fiance while im waiting for my k1. 

If they say who u visiting id say my fiancé of course wont lie. 

As for sttong ties here um i dont have any

I just have not seen her since November last year and id like reset the distance if u knw wat i mean spend sum time relight the flame before i return to complete the process

Hmm, as said before, there is no harm in applying and trying to get it. However, if you don't have strong ties to your home country, it is unlikely you'll be granted one. I don't know much about SA though. It really depends on the embassy.

That may be true, but you cannot immigrate until you have been told you can legally enter the US. Without ties to your home country, you may be denied. They could think you would visit with intent to marry and remain. Just a word of advice. When you go for your K-1 interview be sure to bring pictures of the two of you with your tongues in your mouth. Lol!  🤪

OP, you have clear immigrant intent. Try to prove you won't stay, marry & file for a GC on this upcoming trip. It's a pretty tall order IMHO.

You are free to apply and others have been approved in your circumstances. However, approvals with a pending I-129F petition are exceedingly rare.

The CO is required by law to presume that all tourists have immigrant intent, and it the applicant's requirement to overcome that. That is through credibility, having strong ties to return home, etc. With little to no ties as you noted, the cards are stacked against you.

The CO cannot issue a visa to an applicant that they believe has immigrant intent.

Nothing to lose by trying, though...only the $160 application fee.
