Her sister keeps telling her that she filed residency for her, but we think her sister is not telling the truth. The previous filing might not be a negative factor......but Haiti is not an easy country from which successful B2 visas have been granted.  She can certainly apply.  No one can really predict the outcome.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A point well made, @Dee elle.

 

A poor person from another country is a higher risk of overstaying for a better life. Especially if that person has relatives in the US to help them.

 

ETA: Now that I see that the country is Haiti which has a tough embassy, and all of the issues and confusion about which family member filed for her, I don't think your MIL will be getting a visitor visa anytime soon. But she is still free to apply.

Okay but her sister still keeps telling her that the papers are in process now. If there is a residency still processing, will it hinder a tourist visa? Like I said we think the sister is lying, but we would like to check on that if anyway possible. 

Her father died but now her sister is saying she filed right after the Haiti earthquake for her.

If there is a current immigrant petition in progress, it could have a bearing.....you could try emailing USCIS....but she might not know until she applies....good luck.

We went by the embassy last year and his mom asked many questions to the guard. We were told she used to work in the consulate section of the embassy. She told his mom since she was older and wouldn't be coming to work that it would most likely be approved. That's what she said anyway.

My father initially filed for me without my knowing, either. Back then, I didn’t want it and turned it down when it reached the local consulate.  I was able to get tourist visas after that, but I had (1) already visited as a tourist on a tourist visa a couple of times (b) always had strong ties to show and of course (c) officially told them to destroy my petition.

She needs to find out about her sister because one of the questions on the application is about whether anyone has filed a petition for her, and she has to answer factually.
