Hi,

My wife (US citizen) and I have never lived in US. We are currently in France and under a K3 process.

Once I get the K3 and that we arrive in the US, do I need to wait a certain amount of time before making my AOS or can I do it right away ?

Is the I864A is mandatory for the AOS ?

If so, how to fill it since we never lived in the US before? Do I need a second sponsor to fill the I864A (if so, do we first need to live with him for a certain amount of time)?

Thanks for your help!

Manu

1. AOS can be filed anytime after you are in the US and have an Approval notice for I-130.

2. I-864 will be filled by the primary sponsor (your spouse) and I864A will be filled out by the Joint sponsor (if your spous's income is not sufficient) and yes it is mandatory to show you will not be a public burden

You don't need to live with the joint sponsor at all.

Here is the Example you can use http://www.visajourney.com/examples/INS-Form-I-864.pdf

Thanks

Khurram

I-864A is only for household members, so unless the joint sponsor lives with you, they should fill out I-864.
