Affidavit of support 864??

Hello , Everyone and thanks for sharing the experiences it is a truly great help. :)

 

My last year income i filed was $24.800 1099. Got married Feb  this year and put a file on mid May. My income limit on 1099 is bothering me whether i am going to need a joint sponsor or i will be having delayed in process? prior to last year i havent filed a tax plus my income was $0. currently i am working and my income goes above $36K. please help me to clear this understanding what to expect and what not.

If you get a 1099 instead of a W2, you are "self employed".  As such your "revenue" is only considered income (for immigration sponsorship purposes) when it appears on line 22 of an IRS 1040 form.  At this moment, your "current income" on the I-864 will be exactly the same as your 2017 tax return's line 22 figure.

Thanks for your reply but got little confused, so will i be needing the joint sponsor? When my i130 gets approved?

I don't know.  What is the figure on page 1, line 22 of your 2017 1040 form.  If it's less than the income requirement for your household size, and you don't have $3 in liquid assets for each dollar you are short in income, yes, you will need a qualified joint sponsor.

Yes currently i am working as employee w2 and my yearly gross is $36k

Then you should be fine, I think. My 2017 taxes showed 20k because I only worked half the year. My actual salary is 41k.

 

Just make sure you file the I864 instead of the I864EZ at the NVC stage. The embassy told me this form was for qualifying based on current income or assets while the EZ was qualifying based on tax returns.

Last year i file $24,800 and have the transcript from irs. So when i have to submit ill just file only I864 and last year transcript that should be fine right? This year first four month dint work coz mrg and serious sickness of my mom, but current yearly income $36k. 

 

I hope i should be good coz this thing is worrying me a lot. Also i dont have the sposnsor what arw my options if u knw plz share.

pushbrk, its the amount i mentioned of my gross income $24,800.

You still haven't indicated your household size, but if only the two of you, then that would meet the minimum.  Depending on the country and other circumstances, that might work.  It's too close to call.

Sorry, i am the only one and i claim no dependent and i am not dependent to anyone, shes in India.

They Mumbai Consular Unit tends to require all three tax returns to show qualifying income, or they ask for a joint sponsor.  This kind of data is why we complete our profiles here and provide all the information needed to get meaningful answers and assistance.

ohh so i am in trouble. i havent filed 15 & 16 return and income is $0. what are my option is left as i dont have joint sponsor.
