hey , good evening everyone ☺️ , i have a question i'm going to start my k1 visa process with my fiance soon ... so he's  adopted since he was 2 years old and of course he's a US citizen now but in the I-129F form1693841987_Nouvelleimagebitmap(7).jpg.f847b943a8c7fa9dbf379ac783da3eb8.jpg there is a question about Citizenship information so we were  confused should we put he is a US citizen through Naturalization or US citizen parents ??? 

and should we answear Yes or No for the question 41 ?? 

Please can anyone help us 😟🙂

Was any of his birth parents US citizens? Was he born in the US? Does he have US passport?

Well, then I'm thinking that Naturalized is the right answer. Since other two doesn't fit.

Maybe others know better.

Since he was not born in the US, the option that seemingly fits his situation is "Naturalization" (as you say, he is a USC now, presumably through Naturalization?).

 

As I understand the form, 40c refers to children born abroad to a biological US citizen parent.  Do not believe adoption would fall into this.

 

Answer to question 41 depends on whether or not he has a certificate.

yes you're right !!

and yes he have a citizenship certificate

I would assume it’s US citizen parents not naturalization since he was adopted by US citizen parents. If he didn’t go through the naturalization process and was automatically given citizenship through adoption it’s not naturalization.

Children adopted from overseas don’t go through a naturalization process in the way that other immigrants do. Those adopted from Hague countries are USCs as soon as they arrive here and non-Hague cases become citizens automatically once the adoption is complete within the USA. To me that’s different to naturalization. I would select “USC parents”. The form doesn’t specify that you have to be born to USC parents, just that your parents are USCs and you gained citizenship through that criteria. 

 

By by the way, OP, the I-129F is for the petitioner to complete.

While this Is likely true for her fIancee, we can't be sure without knowing his age and if/when he entered the US on an immigrant visa. The automatic  acquisition of citizenship  is true only for those who either entered the US as a legal resident after the Child Citizenship Act took effect (February 27, 2001), or those already in the US as Irgal residents who were under 18 when the law took effect (i.e., those born before Feb. 27, 1983).  If he didn't automatically acquire US citizenship under the CCA, he would have naturalized.  Does he have a naturalization certificate or a certificate of citizenship?

yes he have certificate of citizenship .. In 2008 his dad took him to do it because when he was living with his mom she didn't do it ( his adopted parents are divorcd btw ) and he went to USA in 1997 when he got adopted and now he have everything a certificate of citizenship and an american passport !!
