Hi All!

 

I have been off the radar here for a while, as I tend to worry too much... so taking some time off from thinking about all this definitely was needed. Last night my attorney's office called informing me that they have received an appointment for my I-751 interview in mid-September, I am a waiver filer.

 

Just a little bit of background, most probably don't know my story. I entered the US in November of 2013 on a K1 Visa and got married to my ex-wife in January of the following year. The marriage was very short, less than a year – she basically abandoned me and our dog – but more about that in a bit. I filed a ROC Waiver case in August of 2016 and have been waiting ever since. The case was prepared with the help of my lawyer, and due to the short duration of my marriage (and other circumstances that also have to do with some "peculiarities" of my ex which I will go into later) I didn't have a lot of "hard" evidence to submit (such as a house in our name etc). I am probably forgetting some of the submitted items, as it's been a while, but a rough outline of what I submitted below:

  • Coverletter (16 pages) outlining my entire relationship with my ex, spanning from the day we met, the ensuing chaos and abandonment to the present situation at the time of filing. The letter also describes my ex's mental health issues that were the main cause for the marriage to fail.
  • Pictures of her visiting me in Europe.
  • Pictures of our wedding at the beach (it was a very small wedding, as we didn't have much money at the time and planned on having a larger celebration once we had absorbed the financial strain several issues had put on us.
  • Three sworn letters by close friends of her affirming that our marriage was real (also confirming that her mental health issues had a very strong impact on my own well being.)
  • Some bank statements showing that she was put onto my bank account, although that only happened towards the end of our relationship.
  • The lease for our house, in both of our names.
  • Both of our driver's licenses showing the identical address.
  • Screenshots of the total amount of Facebook messages we sent each other (please don't judge - in excess of 100 thousand messages), including one or two screenshots of messages per month for the entirety of our relationship showing that we were a couple and planning the future.
  • Copies of all the letters, notes and cards we sent each other.
  • Copies of Western Union transfers that I sent to her to support her while we were waiting for the K1 approval - she had already moved into our together-home, which rent was much higher than her apartment.
  • Copies of hospital reports of me having been admitted over-night after having a mental break down due to what ensued during our relationship.
  • Note from a psychologist which I consulted while visiting my sick father in Germany due to the mental distress from the relationship with her.
  • Receipt from a psychologist in Florida which I consulted to help with the relationship (I was only able to visit her once, as I had to keep it secret from my ex - which was difficult.)

 

I am not blaming her alone, it is always easy to vilify others. But the fact is that she had major mental health issues of which I wasn't aware (more accurately didn't want to see as what they were) which resulted in her treating me very badly and in the end abandoning me for someone else (while lying to me about her whereabouts). All this while I was already struggling from having moved to the US and my father becoming very ill. It was a very bad time, I lost an almost incredible amount of weight and was incredibly depressed. I was at the end of my rope, in retrospect I can't even relate to the shell of a being I was at the time.

 

A friend in California offered me to spend some time with him while I was trying to mend the relationship with her (she told me that she was visiting her sister in TX, which was a lie - she was already with her soon-to-be next husband in Southern California). To cut the story short it all didn't end well and one morning she sent the the divorce paperwork via email threatening me to "ruin my life" if I didn't sign it within the hour... which I did. As a side note, this new husband found my contact information and called me crying just two month ago, she abandoned him (and her other dog - which she had for 13 years) in the vilest way as well. This is her third divorce, and she barely 31.

 

I slowly started to rebuild myself and am now in a better position than ever before. I have a fantastic job and have fallen deeply in love with one of the people who were there to help me while I needed it the most. We just moved in together (which required extensive background checks due to her occupation) and we couldn't be any happier. I am really stressing about the interview now, if I don't get approved my whole world will collapse. I will truly not know what to do or where to go. It would also put a lot of stress on my fiancée - emotionally and financially.

 

Is the interview a good or bad sign - especially considering that I have never received an RFE? Any comment would be much appreciated.

I will certainly attend the interview, and being honest is always the best way to go - especially if you have nothing to hide.

I'm only so worried since my marriage was so short and I don't have as much hard evidence, such as many bank statements etc. 

All I have is a solid amount of more "circumstantial" material (as described above) supporting the story of what happened... and so much depends on it. Heck... my whole current live depends on it. 

 

What seems odd to me is that, although I didn't have a solid amount of hard evidence (not a lot of financial commingling since we didn't have a lot of money at the time) - I didn't receive an RFE, but rather got the interview right away. I know I am probably overthinking and that there is no straight up answer to it...

But I am wondering if that is more of a good sign or rather a bad sign?

Is it more that I made a good job at illustrating what happened, so that despite of having not much evidence USCIS just wants an interview to get a bit of a better idea of our relationship - or is it a bad sign in the sense that they aren't wasting their time with an RFE?

 

I know that what happened might seem very odd to anyone that hasn't seen first hand what a failed relationship with a person suffering from narcissistic personality disorder entails. It was hell and I just want to finally be able to close this chapter of my life and move on with my current, wonderful fiancée and the life we have built together.

Hi there, the interview is a good thing, at least you can explain everything in detail. Like other people said be honest and bring as much evidence with you to the interview. You should be fine, if you can proof that you had a bonafide marriage. Don´t worry too much. Just prepare yourself for the interview. 

I am sorry that you went through this hard time. I hope you are feeling better! Ich wuensche dir viel Glueck!

Interview isn't a bad thing, it is actually a good thing that someone was already touched your application and will move forward to process it.

Sometimes interview process is a matter of validation and to check that what ever you wrote to USCIS which is 10 pages you said were true and accurate.

If I were you just review again the letter that you sent to USCIS since it was 2 years ago already, so you can still recall what are the information that you wrote and sent to USICS.
