Filed I-751 in April 2018, recently my USC spouse lost job and plans to claim unemployment benefits starting Sept-2018.

 

I'm currently employed (salary above poverty guideline by USCIS) - we been filing taxes together so far, will this affect pending I-751 case and N-400 (in future).

N-400 Application Timeline :

Application sent via mail - April 15th  (Field office Dallas, TX)

NOA Receipt date - April 17th

Biometrics receipt - April 22th (appointment scheduled for May 14th)

Biometrics completed - May 7th (Early Walk-in)

Biometrics completed - May 7th (Early Walk-in)

Interview scheduled notification - November 12th (via email - waiting to receive letter in mail for actual Interview date)

Interview completed & Case approved - November 17th

 

Naturalization Ceremony (in January 2020 - waiting on notice)

@sharin Sorry to hear that your spouse lost her job😔 

As far as current USCIS policy, the facts you described, will not effect I-751 and N-400. For right now you are good. 

The policy may change in the future though. They are already talking in the media about people who rely on government benefits such as Medicaid, Food Stamps, etc.

12/11/2018 - I-751 mailed (requested a fee waiver) to Lewisville, TX via FedEx

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

Discussion in media is for Immigrants who rely on Government benefits- not for US Citizens. And for unemployment benefits, anyone is eligible as long as you contributed for social security (paid taxes etc.) Unless I'm missing any recent development. 

 

Also, we definitely don't plan to request Medicaid and food stamps 😅

My US spouse is unemployed as well. He is unemployed by choice, so he didn't receive any unemployment or other benefits. He did receive free state insurance until I started earning enough (I am a freelancer, it took me some months to be full-time). 

the discussion on relying on gov. benefits is about immigrants, not US citizens. Though I am confused as - at least in my state - you actually cannot get food stamps, free state insurance, disability or other gov. benefits unless you had a green card longer than 5 yrs. By that time we will be citizens. So I guess it is really trying to track other people, not those who got their GC through marriage.
